Dear all,

 

I am posting here for some advise to see if anyone has have any similar experience. It would be best if there are lawyers around who can advise.

 

About 2 months ago, my cash card got stolen for the 4 time. This time, the thief smashed the plastic cover of my IU to get the cash card ($200+ inside) which resulting in me having to change my entire IU as it was damaged. So, what I did was install a metal cover over my new IU which was hot wired to my motorcycle battery. Anyone who tried to open the case with out disabling the bike security got a nasty electric shock.

 

Anyways, what happened was that on friday, I went out for dinner with my girlfriend near geylang serai. So i parked my bike near there. We had dinner and while walking back to my bike, I noticed a large group of people gathered near where I was parked. As I walked closer, I realized that there was police standing next to my bike and asking a few guys questions.

 

On approaching, one of the police asked me if the bike was mine. I said yes. He asked if I modified to have the IU unit cover. I told him I did, as I have had cash card stolen several time. Anyways, to cut a long story short, someone had tried to break into my cash card unit, got a shock and got a minor heart attack and burns on both his hands. The police arrested me, but my girlfriend bailed me out. I have had to hand over my passport and have been told that I was not to leave Singapore as the person who got a heart attack also got major 2nd degree burns (what ever that means) on both his hands and I could be charged with causing grievous hurt.

 

Anyways, my point to the police has been that I am just protecting the property and should not be liable for someone else trying to break the law. However the other argument that they gave me was that I knew that people was going to try and break into my IU given the security so i was setting someone up to be hurt badly (I sincerely didn't know it would be this bad, the shop in jb said that the guy would just get a slight shock). Anyways the thief had no business trying to break open my cash card compartment. So ... this leads me to my question.

 

1) Any lawyers can advise me if I am indeed guilty of causing hurt?

2) Will I need to compensate the worker? And if so will insurance cover?

3) Anyone got any good lawyers to recommend? My budget is to keep this below 10k.

4) Is there anyway I can counter sue?

im not a lawyer but from what i knew abt law n logic is that, if a person were to rob a house for example n if the house owner beat him up damn teruk teruk, the owner wld be arrested, cause accordingly from what i know is that unless that robber attack the owner then the owner can defend himself, but if the robber just plan to rob the house n u stop him, n on top of that u cause him to 'suffer' then its ur fault

anyway bro, the best thing is that top up little by little in ur cash card in the future, so not so heart pain when cash card lost... i had personally lost 12 cash cards already... sadly

Sounds very interesting.. Will keep staying tune here to find out the outcome of this case.. Anyway upz to the TS, indeed very sad thing he got busted, but dat fellow who got burnt deserves it. If I'm the judge I'll sentence him 3 mths jail + 3 strokes rotan for stealing and vandalising.. For you I'll accquit you free from charges.. LOL...

wow. You are a great guy! I support your vigilante justice of booby trapping your iu. I unfortunately do not know of any lawyer that might be of assistance. but i would appeal that the whole biking community rally behind you because you are one of a kind and we need more people like you around.

 

But i hope that guy was really intending to steal ur cashcard and not accidentally touched ur iu. lol. thats like damn suay!

Think it's best you consult a lawyer instead of getting amateurish advice here. Has the police charged you yet?

 

To me it's akin to setting up a fence with spikes around your property. If a burglar gets hurt climbing over the fence can police charge you for setting up the fence? But it's really an open-and-shut case. Good luck to you.

The law suppose to protect people like us who work our asses off and pay taxes, not theives and scoundrels who goes around stealing our stuff. WTF is wrong with this man... Sg is becoming more US-like.

 

I think it is best you consult a lawyer proper, pro bono or not, will be better against our "advises" here.

anyway there won't be any lawyers giving advice here cos its their ricebowl. wat u did was right thing in a wrong way.

 

law in sg is such tat you do not take the law in your own hands. there's gotta be evidence & witness to tell a story

 

for ur case example, e thief can say he saw ur cashcard & was gonna help u keep & wait till u come back? if u saw him taking ur cashcard & walking away, still u cannot accuse him either. if u confront him & he acknowledge to taking away ur cashcard, u need to ask reasons. if he denies, e story is in ur favor (provided witness & evidence stands still) but not the any extent of physical harm as u weren't threaten in any way.

 

FYI, try remembering the no. of ur old cashcard. if anyone were to refund e deposit, tat no. is traceable

 

new cashcard comes with insurance. remember the card no. & get urself insurance...

has the thief really been identified as guilty?

 

i sometimes will kaypoh out of kindness if see fellow bikers forgot to do something (key nvr take, coupon falling off, cash card still in IU). So i take first and leave notes and contact. Makes me hestitate nowadays whether i should continue doing kind deeds or just myob :dot:

 

but still, ts wish u luck do keep us updated.

As for the law matter, with reasonable lawyer being engage (if necessary), I feel the justice will be with you & they will let you go just with stern warning. What you may lost are just the waste of you valuable time attending to the matter. :goodluck:

upz for TS, we will support you.. but... i also dunno the outcome or etc... anyway, seeing a metal cover for IU, dun assist to keep for anyone.. else kanna shock ourself.. lolx.. i also help a rider to keep his bike keys and leave a note in his LOCKed IU unit..

 

oh yea.. TS, how much did you do up your electric shock IU? out of curious.. :) will love to put it in.. but will install a switch.. just in case... :D

i noticed that as well. There is a clause stating something like a break in or smashing of windows which is invalid to bikes.

I think normally we don`t accidentally touch IU with both hand? Unless otherwise.

well for the past 1 mth..i lost 2 cash card..both have value ard $20..1 at C carpark at T2 Changi aiport...2nd was taken at Family court...dam to those ******* who stole it

Is a part and parcel of owning a bike. But till date i have yet to lost any cash card.

 

I tie a string to my cash card to my keys. So i forgot..... the string will make sure i can`t move 1m away from my cash card.:angel:

Charge ERP never mind still charge us some more for paying the ERP!

 

In Melbourne you have up to 3 days to pay your Citylink (their ERP) equivalent. Why in Singapore must we pay upfront (Cashcard) or pay so that we can pay some more?
