in the olden days.. thievies' punishment is having their hands being chopped off when caught.. being slightly electrocuted and burnt is considered light in comparison.. i hated thievies i had so many things stolen.. shoes, cashcards, clothes, wallets, money, handphones, and even my whole bike.. thievies and vandal are the worst!

I will fix it to every part of my bike! But modified so that Alarm siren starts first then if still monkeying around, shock activated.

Animals and children would have been scared off by the alarm by then, so I think that is fair.

Motorcyclist are the nicest people on the road, try not to kill us.

then must put a warning sign as well.. big and visible..

 

just curious, if we really put such things then put a warning big and visible, will we get charged? i would like to write an example here.

eg a private property, owner display "Guard dog in house. no tresspassing" but some1 saw a $50 note lying near the gate and decide to climb over and take it, guard dog runs out and that person climbs out in time but suffers a heart attack right outside that house gate. is the owner of the property liable?

Anyone can explain technically how the device can provide a electric shock and burns with a 12V battery?

 

My guess is a power inverter to pump up the voltage n dropping the current so you don't end up killing the fella.

Voluntary Causing Hurt?

 

Well, buddy, before any successful conviction, there has to be mens rea & actus rea. Loosely translated from Latin, it means Criminal Intent & Criminal Act. In your case, both do not include Criminal elements. Even if they were to prosecute on the act by itself, the intent is absent. Meaning, there was no intent on your part to hurt anyone intentionally except to protect your property. I'd say that whatever instructions given by the investigator to prosecute you is wrong or will not lead to a successful conviction.

 

Tell me what the outcome from the meeting with your lawyer is. It'll be interesting to know if there is any variations.

Hmm true, though it's quite a grey area ... Recalled this from Poly too - "Actus Non Facit Reum Nisi Mens Sit Rea" (copied from Wiki for accurate spelling).

 

There may not be a blameworthy mind and hence a blameworthy action to cause the hurt, but I believe the authorities can still fault him for positioning the HV device in such a way it is prone to cause danger.

 

After all, if they just "let him go" - people will think that they can get away with vigilante justice, and take things into their own hands. I'm pretty sure the authorities won't want things that way.

 

Was taking a look at Sec. 337 of PC (Cap. 224); it's written "Whoever causes HURT to any person BY doing any act so rashly or negligently as to endanger human life or the personal safety of others, shall be punished".

 

Also in Sec. 336 ...

 

Whoever does any act so rashly or negligently as to endanger human life or the personal safety of others, shall be punished —

 

(a) in the case of a rash act, with imprisonment for a term which may extend to 6 months, or with fine which may extend to $2,500, or with both; or

 

(b) in the case of a negligent act, with imprisonment for a term which may extend to 3 months, or with fine which may extend to $1,500, or with both.

 

Hopefully the TS' lawyer will be able to successfully "knock it" all the way down to something lesser and mitigate as much as possible, such that he may not have to suffer the consequences of having an active criminal record (there's a provision for that under the Registration of Criminals Act, Cap. 268 - I've known of someone subjected to this).

 

Just sharing my personal opinion here though, nothing here should be construed as valid or legal advice. :)

what we need are alarms that allow us to record our own siren. mine will be

think about it, when generic sirens go off, how many of you have actually turned your heads to look? if we have custom alarms like that, everybody sure see one

Burglar climb over the fence, fell from the fence and broke his leg, can sue you for building the fence too high or not?

 

Don't know how the ERP unit looks like but if it's metal, sounds like the whole thing is covered up (cannot see whether there's a card or not). Now why would some boliao person want to open up the cover to see if there's a cashcard?

well, not in singapore, but in the US, if this webpage is anything to go by, it's a case of anything goes, like the kid who fell through the skylight while on his alma mater's roof, sued and settled for damages.

I agree with bro schwein.bissen.

I think negligent act is more appropriate in this case, and the TS should bear liability for placing such an device, where it can be accessed so easily in public.

 

My IU unit's display had been spoilt for yrs, meaning that I cannot see the stored value of my cashcard but still can be deductible when going thr ERP gantries. Sometimes, I will insert my cashcard into other ppl's bike just to check my cashcard's value Hahaha

 

What I am saying is that it is hard to determine the criminal intention of the person who was shocked, and he can change his version of story anyhow.

Maybe you should have put a "WARNING! HIGH VOLTAGE" sticker on the cover of your IU so that you can indemnify yourself. At least you can tell the police that intruders and thieves would have been forewarned and they proceed (the theft) at their own risks.

 

Yes putting a prominent and appropriate warning would be the right thing to do.

 

Just like you can put up a fence around your property but you cannot put up an electric fence, and certainly no other hazardous traps unless there are adequate and prominent warnings.

hmmm, so if we put a "dangerous! electric fence here, high voltage" sign, we can put up that fence? I mean the sign is EVERYWHERE.. unless you can't see.. is that an offence if someone get electric?

The issue here is,TS should not go on a vigilante mode by wanting to catch and hopefully prosecute a likely cash card thief.

 

Wanting to catcha cash card thief is easy.

 

Example places like Little India, Orchard road , area around Mustapha shopping centre, china town...etc.

 

All you have to do is park your bike there with a cash card inside the IU and wait from a distance to monitor your bike...in a matter of minutes ,someoe would reach and open your IU unit and steal the cash card without knowing the owner is watching him!

 

Caught him red handed... right?

 

But the issue here is really catching and detaining him, without yourself or the thief sufffering hurt if a struggle or fight were to happen.

 

Without the Police being actaually at the scene, citizen arrest does have it's pitfall.

 

So why go to such an extent as to lay a trap in the IU to catch a potentiol thief?..when seeing someone stealing your cash card is , just to do the above which I had described.

No matter how angry we are at this theives, we shouldnt result to such gadgets. A diy reminder could do the job =)
