Bike Accident compensation - advice needed

thanks for the excellent info... At least this can estimate the %tage amount for claims... Is it confirm that TP reports will be out ard 6 months or longer? I am still waiting for the report too... Is there any site to look for how much the claims for each injuries? Eg guidelines!

I think I've already stated earlier in this thread about the compensation guidelines. Any fractured major bone, you can definitely expect 5 figures. But whether it's $10,000 or $99,999 depends on how long your recovery process is, how much permanent damage your specialist assesses you to carry, your lost income etc.

 

Honestly, I'm also very interested to know my rough compensation amount but I asked so many people (mechanics, riders, lawyers etc); the answer is as low as $10,000 to as high as $100,000. So I'd rather just not think about it for the time being and concentrate on getting well soon.

 

I've found some guidelines online, but those are mainly cases in the US. As you know, US is a country known for trivial lawsuits (got people drink at bar until drunk, fall into manhole while walking home and can sue the town council for hundreds of thousands - AND SUCCESSFUL!) so not exactly a very good indication. But yeah, all the fractured femur cases I read at that website were upwards of US$50,000.

 

About TP report, I'm still waiting also. Just got news that the driver in my case will be charged for INCONSIDERATE DRIVING though. What's the penalty? $170 fine and 9 demerit points. While I'm sure he didn't mean to commit the offence, I just can't swallow the fact that handphone driving carries a more severe penalty. For that matter, even beating a red light already constitutes $200 + 12 demerit pts. So knocking down a motorcyclist by not checking traffic is a less serious offence? I'm resigned...

Your lawyer can look this up on Lawnet and advise you.

No point doing it on your own unless you happen to know quite a lot about the law, because you have to pay to get access to Lawnet and you still need to interpret the findings in each case to see if that case is relevant to you or not.

Hi everyone,

 

Today my brother and I went to Gleneagles hospital for the second opinion. The doctor said that my brother is very lucky to have such a good recovery because this type of injury is not common. And normally people with this type of injury will have their foot amputated.

 

No wonder last time my instructor told me after we kick up the clutch, we need to bring our foot back to the top of the clutch n foot rest instead of leaving the foot in between the clutch and foot rest. My brother foot was caught in between and due to the accident, most of his foot ligaments were torn. Of course we should wear proper foot wear instead of slipper during riding.

 

 

What the doctor did???

1) Measure the scar

2) Measure the muscle of both legs. ( injured left leg muscle shrink by 0.5cm compared to the normal leg)

3) ask my brother during raining day whether got pain

4) How the injury affect your present job.

5) Go for x-ray

 

No payment is needed as the bills n report will be sent to the lawyer.

 

After the lawyer compile everything then can advise us of the estimate amount. Once I have the information, will update here.

Attached above was my brother accident.

 

Blue – Taxi driver who cause the accident.

Purple – my brother bike

Red – SBS bus

 

The bus obstruct the taxi driver my and brother view. Taxi driver did not do proper checking and dash in from the opposite road. My brother can’t do anything much to prevent the accident.

Hey, just seen the lawyer last week and made appt with Gleneagles Hospital too.. What I have gone thru is also the same with harni's brother. My muscle shink by 1 cm for hand and leg.. movement of hand better but leg is horrible.. in terms of angle, way out of normal; compare to my the other leg... Ask what's my job.. had X-ray... measure the operation scar...

I asked the lawyer what's my chance and roughly how much I can get.. He told me my chance quite high.. but still depend on the judge and TP report. However he gave me a minimum amt I can expect... Will post more if there's a confirm breakdown... It will take some time to confirm the amount.. At least a year to confirm..

 

p/s : What i get might not be what you got... what you got might not be what i will get... we cant compare due the circumstances...

Just to add another point here , not trying to be a wet blanket but stating material facts i know of

 

If your compensation amount submitted is deem high by the defendant's lawyer, they have the right to ask for medical re-examination especially, (here comes the sucker punch) if your 2nd opinion was done by private hospitals such as gleneagles , Raffles medical etc etc ..

 

Which means more complications and perhaps more delays ...

 

However, if your medical report was submitted by a goverment doctor (eg. NUH,SGH etc etc) they normally wont ask for a 2nd review and mostly will try to settle a suitable amount with you, because everyone knows govt doctor won't play a fool with reports and they are very mostly base on what they see. Meaning no exaggerating by them.

 

Conditions varies for many people and different type of sufferings and injuries. In a nutshell, im not saying private hospitals doctors will exaggerate. Sometimes lawyers have tie-ups with private hospt doctors, that's why a 2nd opinion will be sought by the defendant.

Just wondering, base on the Govt Hospital (GH) report, the type of injury that happened, how are they paid to our claims? The GH won't say what will happen in the future! They will write that the patient has fully recover but won't say what will happen in the future...unless it happen at the point of accident. I think the 2nd opinion is to verify what will happen and be more precise in the report. I find that GH doctors will not write a very detail report on a patient. Even if you have cut or bruises here and there after accident, it will not be in the report. They just write the serious problem and that's it... If a person's accident is cause by others like hari's bro, he deserved the claim amount. I think if the case is genuine, we should not worry and let the lawyer handle.. JMHO..

This is why claimants with serious injury claims should always consult a lawyer who is familiar with personal injury claims.

 

While property damage claims could be settled quickly, injury claims are much more difficult to quantify.

 

The claimant should always be advised, especially where there is potential loss of future income, future medical treatment or loss of use of some bodily function. These are the most difficult items to quantify and the most likely to be challenged. Other items like past medical expenses and loss of past income are less likely to be contentious.

 

With the benefit of good advice on his position, then he can make an informed decision on how to proceed with his case and whether to accept a settlement offer.

hi, just thought of sharing, for those who are waiting for the TP report and was told 6mths... try not to bet your life on that because my accident was on 29 March 2005 and only on the 17 Jan 2007 then I got the verdict, Inconsiderate driving by the female driver, she got fine $200 and 9 demerit points for my broken ankle and 9 mths of suffering...

Bro, do u have any witness to your accident? Did u call to check with the TP before the report was out?

my case no need witness because a QX if following right after the vehicle in accident:) So her statement swee swee admit everything. yet it took coming to 2 years...

my case there is a change in the IO, the initial IO is a biker himself so he was quite fedup with the driver too:) But he told me he ORD in few months time so I guess he didn't manage to wait out on my case and pass over my case to his colleague who sit on my case.

ya, after i discharged from the hospital I have engaged a lawyer to file a civil suit on the female driver, the process is actually just engaged a lawyer then his secretary will follow up with you like asking for the police statement, receipts, doctor's report etc. All you need to do is to go to the specialist's appt, physio appt, etc and keep those invoices properly, I have a file which is almost bursting opening with all the necessary documents, remember whenever you submit your original mc, receipts etc to your lawyer, ask for a photocopy. So you will be able to track those documents in days to come. So meanwhile, you have to take good care and try to recover, upon full recovery, call up the law firm, inform them, they will then request for a final specialist's report on your injuries extend. After which, together with your documents for claim, specialist's report, TP verdict etc. Your lawyer will file the writ of summon to the other party insurance company, if they failed to respond, it will be filed to the party involved in the accident as writ of summon is usually endorsed by court. Sooner or later they will respond to the amount you want to claim and carry on from there... :)

Don mean to be rude and no offence, r u able to tell what were you injuries and how much were expected of your claims? Same if you do not want to put the amount, put $XXXX and high and low range... Respect your decision..
