hello forumers,

i have this situation.. i haad a wave a few months back.. and i traded wit a forumer for his super 4 version s. we just added name toeach bike and h, inshort be sub rider.. we had an agreement.a written one.. no lawyes or anyting.

 

after 2 months, i have sold d S4 and got a spark.. but he is still riding my wav. tats the header.. now for th body, he has a LTA fine and he has not paid till a court letter is here.. i have called LTA and told them tat my sub rider is riding.. they said they dun care and just edd payment..

 

I am supposed to attend court.. i know i can be a bas***d and take tat bike away frm him as he hsa brached the agreement of not settling the bikes traffic offences.. but i dun intend to do.. if i go to court, wat must i say.. he can settle the fine by paying an admin fee to the cpurt of up to 200 bux.. wat if he does not pay.. isit k for me t take back the bike as he has breached the agreement..

 

will i get inti trouble.. the agreement is btwn us.. no lawyers hav been involved in the agreement..

 

please help me

bro ..

 

legally, u are the owner of the bike that the other party is riding. any LTA fine, you are responsible for it coz u are the legal owner. they do not entertain reasons such as, the sub rider ride the bike or so forth. it's registered under ur name .. all fines goes to you.

 

my advice, settle the compund offer before it gets more. go down to LTA, see the officer there, try to compound the summons and avoid going to court .. you could try to appeal or mitigate your case to the officer at LTA.

 

then settle the fine with the other party.

 

since no agreement takes place .. you have all the right to that bike.

well .. i wouldn't know what's the content of your agreement , but if there is any provision of you taking action or holding him responsible for any fines or summons incurred, you may take back the bike until such time he settle the said fine.

written agreement with both your NRIC NAME AND SIGNATURE can be still used as a valid evidence in court. however i dont think u would want to take up legal suit on such matter as you would end up wasting more money.. i guess u just take back the bike till he settle the amount. if he were to lodge a report against you for "stealing" it would not valid as you in the eyes of the law is the rightful owner.. so lets say if you were to bas***d him and take back the bike he also LL cannot do anything about it. :smile: but dont be such a bas***d la :x

but i'm just curious.. have you asked him why he never pay the fines?

 

but on the case of taking back your bike, i feel that you should do so...

 

reason very simple .. before you go to court and kenna charge for MORE traffic offences... you're just keeping the bike locked up so that it cannot go out on the road.. minimise the chances of having MORE summons....

 

thats the way i see it...

 

but i'm also curious on another note... you sold the super4... but... is it your name already?

if he sold means tat the owner already agree with it.. u need log card to sell your bike.. :smile: yeah alot of people have been telling him to take back until that fella pays for the fine.. so irresponsible how people can be..

ya..he agreed..and i sell it aredy.. he told me he paid aredy.. apparently, he has 2 ERP fines.. he paid for 1 but did not pay for the other 1.. and it has expired.

if it's just expired .. pls make ur way down to LTA soonest possible, juz say that you had overlooked the fine expiry date and could please, if possible, to extend the expiry date and you'll settle the fine.

 

better than go to court and then be given a fine, multiple times more.
