Dangerous Driving

 

 

 

The Law – Section 64(1) of the Road Traffic Act Chapter 276 states:

“If any person drives a motor vehicle on a road recklessly, or at a speed or in a manner which is dangerous to the public, having regard to all the circumstances of the case, including the nature, condition and use of the road, and the amount of traffic which is actually at the time, or which might reasonably be expected to be, on the road, he shall be guilty of an offence under this Act and shall be liable on conviction to a fine not exceeding $3,000 or to imprisonment for a term not exceeding 12 months or to both, and in the case of a second or subsequent conviction to a fine not exceeding $5,000 or to imprisonment for a term not exceeding 2 years or to both.”

 

Section 64(2) of the Road Traffic Act states:

“On the second or subsequent conviction under this section, the convicting court shall exercise the power conferred by section 42 of ordering that the offender shall be disqualified from holding or obtaining a driving licence unless the court, having regard to the lapse of time since the date of the previous or last previous conviction or for any other special reason, thinks fit to order otherwise, but this provision shall not be construed as affecting the right of the court to exercise the power aforesaid on a first conviction.”

 

Section 64(4) of the Road Traffic Act states:

“Any police officer may arrest without warrant any person committing an offence under this section.”

 

 

Examples of Dangerous Driving

 

a) Failure to conform to the Pedestrian Crossing Rules resulting in pedestrians taking evasive action by stopping abruptly in their tracks or ‘jumping back’ to avoid being collided into;

b) Sped (exceeding speed limit by 20 kph) through a junction against the traffic red light signal resulting in other vehicles having to take evasive action to avoid a collision or a near collision;

c) (1) Cutting across double white lines, or

(2) Overtaking in the face of on-coming traffic,

 

and forcing on-coming vehicles to take evasive action to avoid a collision or a near collision;

 

d) Switching lanes repeatedly at speed well exceeding speed limit by 40 kph without signal or driving in a zigzagged manner at speed exceeding limit by 40 kph, and by so doing encroached into the path of vehicles resulting near collision with these vehicles;

 

NOTE: These examples are merely illustrative. Every situation is assessed factually on a case-by-case basis and the evidence available.

The Law – Driving without due care and attention or reasonable consideration is prescribed for in Section 65 of the Road Traffic Act Chapter 276 which states:

 

“If any person drives a motor vehicle on a road without due care and attention or without reasonable consideration for other persons using the road, he shall be guilty of an offence under this Act and shall be liable on conviction to a fine not exceeding $1,000 or to imprisonment for a term not exceeding six months or to both, and in the case of a second or subsequent conviction to a fine not exceeding $2,000 or to imprisonment for a term not exceeding 12 months or to both.”

 

There are two distinct offences under this section: careless driving (ie driving without due care and attention) and inconsiderate driving ( ie driving without reasonable consideration).

 

Careless driving is furthermore prescribed under Rule 29, Road Traffic Rules, which states:

 

“No vehicle shall be driven or ridden upon a road otherwise than in an orderly and careful manner with due regard for the safety of others.”

 

Careless driving is punishable under Section 131(1A) Road Traffic Act Cap 276 which states:

 

“A person who is guilty of an offence under this Act shall be liable on conviction, where no special penalty is provided in the case of the first offence, to a fine not exceeding $1,000 or to imprisonment for a term not exceeding 3 months and in the case of the second or subsequently offence to a fine not exceeding $2,000 or to imprisonment for a term not exceeding 6 months.”

 

 

Examples of careless driving

 

a) A driver who whilst reversing failed to look behind him for possible traffic and almost caused a collision;

b) A driver who crossed the centre white line when overtaking and failed to look towards the direction of oncoming vehicles as his attention was diverted;

c) A driver has switched his turn left signal and makes a right turn. This caused confusion and panic to those motorists driving behind his vehicle.

 

Examples of Inconsiderate Driving

 

a) A driver when reversing looked back and saw an on-coming car but chose to ignore it. This is a selfish, inconsiderate thought and the offence becomes one of inconsiderate driving. In fact, it could as well be dangerous driving depending upon the circumstances;

b) A driver overtook a car and crossed the centre white line knowing there was an oncoming vehicle on the other side and chose to ignore it. This again could also be inconsiderate or dangerous driving;

c) A driver switched his indicator to change lanes and did it so soon resulting in forcing the vehicle behind him to apply its brakes to avoid a collision. This is an example of inconsiderate driving.

 

More Common Examples of Inconsiderate Driving

 

a) Swerving into the path of another vehicle without thought or regard for other road users thereby forcing them to take evasive action by applying brakes or swerving;

b) Cutting across the path of another vehicle when executing a turn-right, left or ‘U’ turn;

c) Failure of a driver in a vehicle emerging from a minor road to give way to vehicles on a major road especially at road junctions and causing vehicles to apply brakes or to slow down;

d) Failure of a driver to give way to another vehicle on his right at an uncontrolled junction;

e) Changing lanes or coming to an abrupt halt without prior warning thereby causing other vehicles to slow down or apply brakes;

f) Failing to obey traffic light signals and causing a near collision;

g) Failing to form up correctly and thereby causing a near collision or other drivers to take evasive action;

h) Failing to conform to directional arrows and thereby causing traffic congestion or near collision;

 

NOTE: These examples are merely illustrative. Every situation is assessed factually on a case-by-case basis and the evidence available.

People ask me, "Why ride bike?" I ask them back :"Why drive car?"

all these offences with such heavy penalties are done everyday...n yet we aren't able to do anything abt this.

Don't think he can do anything to you. By submitting your number plate to Uncle Sam, TP will just take notice and follow-up as a complain as the uncle u mentioned is not a Police Officer or something. Don't allow such stuff to dampen your mood, just ignore the guy and continue your life. If he thinks he's safe, maybe he should think again! Cheers!

yah i agree. s'pore law is more and more unreasonable liao le.. but also right lah, we r living in singapore. if the tp dun fine us, their pay come from where leh.. hahaha, last time i bought my bike and i was a hell rider on the road. ppl blow me i can follow all the way to that idiot house.. lolz but after some accidents and incidents i decided to be a safetly rider.. wanna be a hell rider pls go malaysia ba.. the road offence there is nth to us..

btw this law is "stupid" & doesnot apply .. unless u are caught red handed by tp or rather TB u can do whatever u like .... ie law is only for TB to fark riders NOT TO PROtect innocent riders ....

Y'all, I was involved in an accident with a drunkard on Friday night, close to midnight.

 

I was travelling along Balestier road, towards Lavender road. As you all know, it's a 3 lane road, and I was abiding by the traffic speed limit of 50km/hr.

 

About 3 car lengths away from me, was a Comfort taxi who kep accelerating, then deccelerating, as it always is, at night. So, as I was scared that he might just jam brake if a passenger was there, I filtered to the 1st lane to overtake him. I've been following the rules so far, as long as my short riding life has had.

 

So, anyway, after I filtered lane, I noticed this Indian man in dark clothings dashing across the road. Immediately, I horned him, and applied my brakes. The indian man stopped in between the dotted lines of the 1st and 2nd lanes. I mean, seriously speaking, if a bloody vehicle horns you, it's to warn you that it's there. right? It's not as though my headlights weren't on or anything.

 

BUT THEN!!!

 

Just as I was about to by-pass this man, less than 1 car length away, he suddenly dashed out in front of me. 1 stride was all it took from him, to get us all into deep sh*t.

 

The impact wasn't that strong, as he didn't fly or anything, but that's because of my low speed. My pillion and I suffered cuts and abrasions on all limbs (it's a darn sway thing that I had to wash my jeans and jacket hours before). The collision knocked the wind out of the pedestrian.

 

I was the first to get up, and immediately checked on my pillion to make sure that she was ok. Next, I checked on the pedestrian, to check if he was ok. He was unconscious, and he REEKED of alcohol. Damnit man, you should have taken the pedestrian crossing, it was less than 50m away damnit!

 

So, as soon as a crowd was formed, I got someone to call for an ambulance, and I called for the police. (though I know calling one would have been enough). As it was unlucky enough, there were CID officers conducting an investigation close by, and so they intervened. There were 6 SWAT officers as well, patrolling Balestier road, and they were there. Shortly after, the ambulance came, as well as 2 TPs. After stretchering the jaywalker off, the paramedics checked with us if he needed to go to the hospital. Then, they were mentioning that these drunkards are always like that, saying that it was the 2nd drunkard case that night itself.

 

Now, I was cheesed off, as I am still.

 

Firstly, I abided by the rules at all times, with the school's teachings still lodged in my brain. I never take the 1st lane, unless I need to overtake, or filter to turn right. I really try not to squeeze, even though it's a traffic jam, resulting in lots of horning from vehicles behind who think that I am taking up space. I didn't change lanes in the junction, I changed it after. I even checked to see if there were any cars behind, before signalling to change lanes. I saw that he was there, and I horned him. It was supposed to be fine thereafter.

The result?

 

Went to Ubi, and had to file a report. The IO was dulfully showing pity to me, but he said that rules were rules, and that I had to be charged with dangerous driving, which is utter nonsense! But anyway, I respect his decision, as it is not an easy one to make.

 

The next morning, I went together with my pillion to the polyclinic to get ourselves dressed up by the nurses, then we had to go to IDAC, and my motordiam. Tmr, I have to head over to the lawyer's side to get them to claim that sorry ass.

 

No, I don't really want to claim against him, as I am 70% sure that he will just declare himself bankrupt, and I can jolly well just go fly kite.

 

But then again, who gives a sh*t if he is declared a bankrupt. I just want to clear my name. Hey, 24 points for dangerous driving is a heck of an offence, even more so as I only have 12 points.

 

However, I am pretty confident that the IO will be able to charge the pedestrian instead of me, going by the investigations. Heck, I've even got witnesses.

 

The procedures following the accident is worse than the accident itself.

 

I'm cheesed off!

Drive : Proton Saga 1.3M SJN plate (11th June 10 - Present)

Ride : Honda S4 Revo FBC plate (12th July 08 - Present)

Former Ride : Phantom TA200 FV plate (9th September 05 - 12th July 08)

eh sashie.. or anyone.. the offence u(sashie) made was travelling at lane1 when other lane is avaliable and not overtaking..? cos u said u were travelling within the speedlimit.. so i've got this question..

 

is travelling in lane1, when

1-other lanes r avaliable,

2-not overtaking,

3-not jams,

an offence?

 

cos sometime, esp at nite, expressways and any roads with 2 or more lanes and all lanes are empty, aso cannot travel in the outermost right lane ar..?

hmm i kena reckless driving already sept 05 at grange road.

 

Scenario was road was clear and was travelling at extreme right lane. Then change mind to travel extreme left.Check blindspot on signal and decided to turn left insted. Nearest car was 2 lamp post away. One shot swing all lanes. Had the privelage of being escorted by 3 TP officers behind the car.

 

Offence was one shot change lane. Curse him in my heart and had to accept the summon. Appeal turned out unsuccessful.

 

Demerit Points: 6

Fine: $150 + scolding from owner

All vehicles should have video recording devices attached to the front and at the back. This will allow us to get evidence of dangerous driving/riding. Usually it happened so quickly that we are unable to recall the details.

 

Since I started riding on Farrer road two weeks ago, I've seen some high speed weaving in and out with very little space tolerance.

 

lane 1    A -+ B
        V  ^
lane 2    C   -+

 

Car A was in lane 1 (the faster lane), car B didn't give way, so car A overtook using lane 2. The distance car B and C is very short. I thought car C would brake, but it didn't. Car A then accelerated, overtook car B and lane changed in front of it, again with very little space clearance.

 

Skilful, maybe, but definitely dangerous.

kanna court for careless driving.

checked the net and thought max is $1000 fine.

 

turns out that judge can still give disqualification.

kanna 3 months disqualification as the pedestrain's injury was quite bad.

13 days hospitalisation and 161 days MC.

i love dividends.

Hi, ppl out there, i know through here can know alot of information on the road. on the 20/11/2006 my bike was laid up. on the 21/11/2006 my bike was on the road and get caught by the ROV. And yet i don't have license. plus i got home probation cos of civil case. wat will it be the worst out come for my case? Will i be sentence to jail? Wat thing can help me now? i'm very lost. i really dunno wat to do. guys please help me.

Friend.. Not worth it lah.. I also got hiong before.. ride for a good 4 mths before getting my license.. I also rode a laid up bike.. Kena sure tear backside left right centre one man.. But then all you can do is pray and try to give them a sob story.

Not much that i can think off to help you though. I'll pray for you my friend.

All Drivers:

 

Be careful on the road. It's not cheap.

 

Speeding:

 

Exceeding 1 - 20km/h = $130 + 4 demerit points.

 

Exceeding 21 - 30km/h = $150 + 6 demerit points.

 

Exceeding 31 - 40km/h = $180 + 8 demerit points.

 

Exceeding 41 - 50km/h = >$200 + 12 demerit points + Court.

 

Exceeding 51 - 60km/h = >$200 + 18 demerit points + Court.

 

Exceeding >61km/h = >$200 + 24 demerit points + Court.

 

Careless driving = $150 + 6 demerit Points.

 

Inconsiderate Driving = $170 + 9 Demerit Points + Court.

 

Dangerous Driving = >$200 + 24 Demerit Points + Court + Vehicle Compounded.

 

Illegal Racing = >$200 + Vehicle Confiscate + Court.

 

Fail to put Seat Belt = $120 + 3 demerit points.

 

Crossing Double White lines = $130 + 4 points.

 

Phone and Drive = $200 + 12 demerit point + Phone Confiscate. Do not hold your hp in your hand when you drive even with loud speaker or ear piece.

 

 

 

Drink Driving

 

For first offence. = Up to $5000 Fine And, or jail Term + License Suspended + Court.

 

2nd time offence = Jail term + Fine + Court.

 

 

 

Other offences

 

Making an illegal U Turn when there ' s no U Turn sign = $70.

 

Fail to Signal when changing lanes = $70.

 

Driving at night without headlights or taillights switch on after 7pm = $30.

 

No Number Plate = $70.

 

Obstructed Number Plate = $70.

 

Obscured Number Plate = $70.

 

Number Plate Of Unapproved Type = $70.
