Bike accident. Need Help

Hi Guys, I just got into an accident.

 

I was going straight, following this car infront of me. Suddenly he jam brake, swerve to the left and do an U-turn right, in the middle of the road. I bang straight into the middle of the front and back door of his car. Once he alighted he admitted it his fault for doing the U-turn in the middle of no where.

 

Took down his details and took a picture. Some bystander assisted to call an ambulance, TP came shortly and ask me to settle privately with insurance since I do not have life threatening injuries. Having shoulder pain, I believe might be muscle tear with a few abrasion here and there.

 

May I know how do I go about for a third party claim against him and maybe some damage. What are the procedure i have to go through. Please advise.

First and foremost very sorry to hear of your incident. Sounded exactly like what I encountered last time. However I settled privately on the spot.

 

I believe the best is to claim his insurance. You need to go lodge an accident report.

 

I believe in your insurance details there are some steps for u to take in this instance. Shall not comment too much on what I'm not sure.

I concur. Make a police report and contact your insurance. They are the ones who are supposed to assist you in these things. Be careful though as the driver might twist the story. Hope that everything is in your favour. :cool:

Sorry to hear about your injuries. May you heal quickly and well. In the meantime, you will need to file a police report as it is an injury-accident. Bring along all the documents from your doctor. Police will ask you to describe, etc.

 

Next, your insurance company will NOT be the one handling the claims. Unless you are claiming against your comprehensive insurance policy. What would be next is that your bike should be brought down to an approved inspection centre as provided by your insurer, can check on their website. IDAC, STA, Vicom or whichever. Within 24hrs of the accident, or the next working day. If you are injured there might be some leeway. You have to file this damage assessment so that IF the other party claims against you, your insurer will have a record of the damage to your vehicle and be able to repudiate their claims.

 

Following that, you should bring your bike down to your regular workshop and see if they are able to do claims for you. Most reputable or larger workshops have tie-ups with lawyers and surveyors. Once the bike shop has your bike, they will advise you to see doctor, collect MC, other supporting medical documents. Usually you will have to sign a letter authorising the lawyer to act on your behalf. From there, they will engage their surveyor to survey your bike and determine what are the damages to the bike and yourself and what other claims they may wish to make against the other party. Once everything is settled, lawyer will ring you up.

 

Your insurance company, in this case unless you are claiming against your comprehensive policy, usually does not do anything. You will have to find either a shop to process the claims for you or seek a lawyer on your own to do likewise. Look for motor vehicle litigation lawyers.

 

When i got into a little ding-up a long time ago, the bike shop told me to go to IDAC to report the accident, then back to their shop to park the bike. Next day, went down to meet surveyor and sign letter authorising workshop/lawyer to claim on my behalf. Went home, sent all doctor letters and stuff to the surveyor. Few months later, the other party's insurer called me up saying that the other driver wanted to settle privately. Told him I had already engaged a lawyer and will let them carry on. A couple months later, was called into lawyer's office to collect cheque. That was my experience. My insurer at that time, AXA, was at no point of time involved in the entire process.

 

In the mean time, I had to fork over a small fee to get my bike back on the road. The bulk of the damage, the shop repaired but submitted their claims on my behalf, cuz mine was quite a clear-cut scenario. The other driver admitted to fault. In more debatable circumstances, the shop may want you to pay the entire repair fee first, in case your claims fail. Or they might repair with no charge upfront, but claim back from you should the claims not go through against the other party.

TP won't file a report unless it involves : govt vehicle, foreign vehicle, damage to govt property, hit-n-run, pedestrians and cyclists, MC of 3days and above, injured party conveyed to hospital in ambulance.

 

 

Oh yes, to TS. Do get the bike down to the workshop as soon as possible and get the process rolling quickly. Think the other driver's insurer has to be notified of claims and come down to inspect the vehicle within a certain timeframe. Things have changed from my time, now it's stated 2 working days.

 

Also, get your police report asap, bring the report down to the vehicle inspection centre when you're getting your vehicular damage filed under the GIA 24-hr reporting scheme.

Hi everyone. Thanks for the advice. I've manage to find a bikeshop and will be meeting the lawyer soon. However, for my broken bone, my specialist appointment referred by the polyclinic is 3 weeks later. Thus, I have to live with the pain for 3 weeks.

Remember if you have 3 days mc and above must make a police report. Ask your law firm to recommend a specialist for you. They shouldnt be letting you wait for so long with nothing done. Sounds weird to me. Throughout my 5 years doing claims in law firm this is the first time I heard that injuries are not attended to. :sweat:

Also very important is police investigation results. With you making a police report TP will step in. Try to secure witnesses for your claim in cases the other party roti prata

I manage to get a earlier slot for specialist and have already seen the specialist. Will be heading for my operation on coming Wednesday to put in metal plates and align the bone straight as it had broken into an inverted V.

 

As for my bike, I've brought it to the bike shop to settle everything for me. Bike shop lawyer had informed that this will be a sure win case. So for now I just have to pray for a success operation and speedy recovery.

Just an update on my case. Recently just spoke to TP, the driver make a false statement and say that he is making a right turn into a small street. The small street is 60 meter away from where the accident happen. From my picture, I've manage to capture a photo of the small sign board that point to inside the street.

 

What is the possibility of the driver getting away from giving a false statement? I'm now very furious thinking about it. He even mention to the TP that i apologize and admitted my fault. Seriously, when the accident happen, it was super near a coffee shop. All the late night uncle rush over and scold him and he admitted his fault in front of everyone and me. I was too stupid to not ask some of the witness for contacts to keep and safe guard.

 

Now is only my picture and my words against just his words. Anyone have any advice?

Just an update on my case. Recently just spoke to TP, the driver make a false statement and say that he is making a right turn into a small street. The small street is 60 meter away from where the accident happen. From my picture, I've manage to capture a photo of the small sign board that point to inside the street.

 

What is the possibility of the driver getting away from giving a false statement? I'm now very furious thinking about it. He even mention to the TP that i apologize and admitted my fault. Seriously, when the accident happen, it was super near a coffee shop. All the late night uncle rush over and scold him and he admitted his fault in front of everyone and me. I was too stupid to not ask some of the witness for contacts to keep and safe guard.

 

Now is only my picture and my words against just his words. Anyone have any advice?

Should have expected this. For mine the driver was lucky I was unconscious and there were no witnesses and cameras. Lets hope there are witnesses willing to step forward for yours. Good luck. :cool:

Go back to that coffeeshop. Very likely the uncles there are regulars.

Good suggestion. While at it get permission from owner of the coffeeshop to paste some notes about the accident and seeking for witnesses. :cool:

This happens every time & that's why we motorists are adviced to proceed legally with proper reporting & all the claims via the insurance agents. No worries. You can win.

I just learned from a friend that most claim cases are not 100/0, most are like 80/20, as in he 80%, you 20% responsible for the accident, even if he head on you. But that's for car vs car, not sure about car vs motorcycle.

 

For your case, it sounds to me like you might be getting the 20% or more due to "failure to maintain a safety distance apart" rule, plus a dispute is involved, plus no witness. Sorry about that, but I know it sucked very much.

 

For now, concentrate on finding your witness to prove the other party is lying.

Do not lose hope. Gather as much evidence needed. Pictures of where the accident hsppened and even the place the driver claimed to be travelling at that shows its further away from the actual location. I sincerely hope everything will be in your favour. :cool:

I believe what TS mean was, he was not actually following the car, but somewhere in the middle of the car's right blindspot.

This is not a front to rear accident. Anyway I claimed a front to rear accident before when I was driving. In summary, I jammed brake, car behind tailgate, unable to react and hit my back bumper directly. I claimed her 110% full damage. Fixed some paintwork scratches at the side that may not look related as well. While the car was at the workshop, I receive $50 daily until the bumper was replaced. The workshop took his time.

 

For TS situation, he bumped the middle of the car's front and back door. So unlikely its the same situation as mine. There is a traffic rules bible book to distinguish whoever fault. Some are 80/20, some are 100/0. If its as how I mentioned, its a obviously car abrupt lane change and is 100/0

 

TS also dont look like hes very good at elaborating.. The driver took advantage.. :/

 

First day suppose to call NTUC settle liao. You drag a few days, he gather advise from shity people, he will come up with tricks. Only on first day when accident happens against bikers, when both driver and rider are in the state of panic, the last thing the drivers would want to do is lying to TP.

My recommendation is if you get into a serious accident and are injured, it is better to let TP arrange for your bike to be towed away and you get sent to hospital instead. Also, this is in the belief that the accident is not your fault. By doing so, TP will have to acknowledge that an accident report will be made, photographs will be taken by TP and you are able to claim more for your injuries. Don't act tough when you don't have to.
