Help, kena summon to Court!

I got a notice from Tampines town council in march for parking behind the macdonald's at the bus interchange. I wrote in to appeal and also suggested that they have a bike parking lot nearby as there wasn't enough in the vacinity and moreover, there are lots of vacant land nearby. The rows of bikes that were parking behind the Mac is evident to the shortage (over 40 bikes if my esitmate is correct). I didn't get a reply from them, but a bike car park were erected soon after. Over time, I forgot about it thinking they have accepted my appeal as did my bike parking proposal.

 

Then yesterday, I got a Summon to appear in Court pasted on my front door. What do I have to do next if I want to appeal? Write to the Town council or can we only appeal when we're in court. And if I decide not to appeal, what is the amount I have to pay? I'm guessing it would be substancially more than the hundred bucks I was fined initailly as they got a court clerk down to plaster the notice on my door! Any advise

Ouch. Painful lesson. At this point is it too late to appeal to MP etc to lessen the fine? $400 is like 20% the worth of my bike!

Think the only way is to go court liao... Tampines central's Mac there too many bikes parking at the pavements hence Town Council will summon 1-2 bikes in random manner. It's safer to park at the bike lots of the carpark down the interchange. I never try parking on the Mac pavement there...

why don't you try calling the town council to see if they received your appeal at the first place. if they did, they tell them that you did not receive a reply and see if something can be worked out like paying the fine since obviously the appeal was rejected. if that fails, guess you can go to your MP and seek for advice but when nothing works, don't forget to attend the court date!

In court, what will happen? Is it Judge will ask plead guilty or not? If guilty, go pay fine, $400. If plead not guilty, go appeal. Appeal to whom btw? If the later unsuccessful, how much will I be fine?

usually if the amt is kinda high for you u pay fully, u can ask to pay installments....no matter wad still kena...haizz....painful lessons learned

hmm..dun bother appealing to tampines town council..they won't give a damn to wat reasons u gave them..i also kena b4..my bike got prob at tamp..so i stop by my fren'z place to check..the lights at the carpark was so deem so i shifted my bike to the void deck..my fren & i was there figuring out wat happened & suddenly there's flashes coming frm our back..

 

guess wat..the idiots frm the town council was taking the pic of my plate..we explained to them..but they simply dun give a damn..

 

soon, i received a letter asking mi to pay $100..i send e-mails to appeal explaining my situation..but got rejected..

 

i've park my bike at my void deck at hougang..but i only got a warning letter..really dunnoe y tampines town council can b so nasty..town council r suppose to make resident's life easier..but think tampines is a unfriendly place..haizzz

 

in the end, my mum paid the $100 to the idiotic section..sillypore is no place for us..haizz

go to the TC and request for settlement. $100 fine + $100 legal fees if im not wrong. Court case would be retracted once payment is made.

First of all, attend the court and plead guilty. Just pay for the fines.

 

Your excuse is not good enought for appeal. You should say 'i need to throw up or having a upset stomach'....or some other excuses...basically these town concils suck and do not bother about you.

 

However, it is good to appeal.

Court fine $400?? Don't think Court fines are fixed! it depends on the no. of charges and the presiding Magistrate on the very day. I suggest you make an appointment to see the Town Council Manager to check . If they have received your letter of appeal, I think it is high handed on their part to serve a summon on you. If this is your 1st offence I don't see why they cannot compound your offence.

The bike lots were created early this year right? Till now then you rec'd court letter yet previously no warning letter from TC, in between there're about 8 mths' lapse... Maybe you should check with TC first if the fines can be lesser before attending court to appeal again.

I don't understand why they'd wanna make you appear in Court without summon letters to let you compound fines or anything...

 

Either that town council don't wanna solve the problem themselves (letting the Court settle) or that after having a valid letter of appeal, they still wanna stand their ground...

Thanks to everyone's advice. Managed to speak to the person in charge of parking offences finally.

 

She offered to withdraw the case from court but still have to pay $150 for legal and $100 for the offence. Total $250. Still alot but it's lesser than the $400 I thought I was to pay. Anyway I'm just glad that I don't have to attend court.

 

They did send me a letter and a reminder I have to add. I wrote in to appeal after the reminder and they confirmed they did receive my appeal and act on it. However, they said they sent me a final reminder to say appeal rejected and when payment was not made by March, they took legal action.

tht one is u no skill lah. i appeal few times liao. total of $700 reduced to less than $50
