i heard of a case where a phantom rider fishtailed and fell off the bike although no contact was made, when a car moved off from the filter lane and the phantom rider e braked. I think the rider claimed successfully.

U might have a case since cabby's error induced you to take evasive measure which resulted in damage to your bike.

Do you have his plate number and/or any witnesses' contact number? How bad is the damage to your bike?

P-plate should be an attitude to safety and riding. There's always more to learn.

No collision, but driver still to blame

She cut into a motorcyclist's path causing him to skid and fall off, but drove off.

Fri, Feb 20, 2009

The New Paper

SHE cut into a motorcyclist's path at the Pan-Island Expressway (PIE), causing him to skid and fall off.

Madam Ong Keh Choo drove off, but two motorists who saw the incident gave chase.

One of them swerved in front of Madam Ong's car to stop her. They then took her back to the scene where aircraft maintenance engineer Jasbir Singh Mann was injured.

Madam Ong was later fined and given nine demerit points for inconsiderate driving over the 4 Feb, 2004, incident .

This turn of events was revealed in a recent Subordinate Courts ruling when Mr Singh successfully sued Madam Ong for compensation.

District Judge Tan May Tee described the case as unusual.

While Mr Singh's motorcycle did not collide with her car, Madam Wong was still held to be 100 per cent liable as she had veered into his path without signalling.

Court papers state that Mr Singh was riding along the right lane of the PIE when Madam Ong, who was on the extreme left lane, swerved into his path.

To avoid crashing into her car, Mr Singh hit his brakes, which locked the rear wheel of his motorcycle.

He fell onto the road, suffering severe injuries.

Two Malaysian motorcyclists stopped to help MrSingh, who was warded in Singapore General Hospital for five days.

In 2006, Mr Singh sued Madam Ong for compensation, leaving it to the court to assess damages.

The two motorists who confronted Madam Ong were not called as witnesses, but Ms Tan believed they were indeed at the scene.

Not only did Mr Singh mention the motorists in his evidence, but Madam Ong and her son, Mr James Lee, a defence witness, also referred to them in their testimony.

Clear evidence

In her judgment released last 31 Dec, Ms Tan wrote that Mr Singh's evidence was clear and consistent even under rigorous cross-examination.

This convinced the court that he was a truthful and credible witness.

On the other hand, Madam Ong's evidence was contradictory and inconsistent.

The judge wrote: "She (Madam Ong) tried to excuse herself from blame on the ground that there had been no contact whatsoever between their vehicles. Her testimony was riddled with inconsistencies and not corroborated by her son in various material aspects.

"Her son's evidence in fact corroborated Mr Singh's account. There was no basis to find any contributory negligence on Mr Singh's part."

Mr Singh declined to be interviewed when The New Paper contacted him.

Damages will be assessed at a later date, pending an appeal by Madam Ong to the High Court.

from what i've been told, the next time you encounter that situation, no contact = no accident = highly possible get summoned for self-skid.

Even you have the car plate number will not help.

Unless u manage to have a witness to vouch for you in order to have a case.

Hey all,

Some people have very very extremely bad judgment.

I have encountered this sort of incident several times before, with my 1st being a close call.

Usual idiots:

- 1st scenario: Filtering out frm side road (like your case)

- 2nd scenario: Turning right frm opposite direction

In both instances, I high beamed to signal my approach, but yet the cars still forcefully accelerate, forcing me to brake.

Practice defensive riding by:

- 1st scenario: Slow down, check middle lane if there is any car approaching frm behind & then filter to middle lane.

- 2nd scenario: Slow down & High beam to signal approach.

Most accidents happen at junctions. Always slow down when nearing them. It does not matter if we have the right of way when these idiots have such poor judgment. We can protect ourselves through the above defensive riding mtds.

Once had a similar accident along kranji. heading straight but a toyota wish turn right from a side road 1/4 into my lane so jam brake to minimise the damage. Skidded from my rxz:pity:. Call ambulance, mc for 3 days for multiple abrasion.

The driver was faulted with demerit points & fine even though there was no contact. But at least he stop & help. Use the tp letter to claim his insurance for bike repairs & 2k compensation.

u skid also get summon??

either 1 of 2 charge TP can slap u

1)fail to take proper control of vehicle

or if lets say your tyre burst or brakes not working

2)fail to take proper maintenance of vehicle

both charge 6 points i think and $70 or $120

my tyre burst on ECP one morning and buang/ LOC with pillion laying in the road luckily no vehicle near... motor kena towed to TP and rider towed to SGH... go to TP make statement for release of bike than kena the summons

Lesson learnt .....

Posted

how come the response so different?

like some people can claim..

others get summon..

are there factors/criteria we need to consider?
