Yesterday I was involved in an RTA at a cross junction. I was travelling straight and there was this car on the opposite road who approached the junction and was going to turn right. I slowed down a little and I knew I was within the speed limit. I believed I got my right of way and the driver should give me way from the right. So I continued travelling straight when suddenly the car just turn in front of mmy path. I braked hard but not enough. My front tyre hit the left side near the rear of the car and I was flung forwards together with my pillion. Both of us landed at least 5m ahead. Luckily both of us were not that seriously injured. but both of our backs felt quite a lot of pain but I endured it and attend to my pillion first as it was my responsibility to do so. All i noe my bike was in a heap of mess with alot of debris on the ground. But the worst and irritating thing is that the car stopped at the side road but the driver never came out. I just saw the car parked there. Luckily there was this witness who witnessed the whole incident and came to help me. I owed him a lot. If ure reading this, I 'll contact u one day and reward u. Anywae back to the story.... I then told the witness to call the driver out and he did so. The witness told me that the driver was a she and he infd me that the driver told him that i did not switch on my lights. Cmon man.... my bike is a super 4 and when u on the ignition the light will aways on. Wat a cheat!! I've observed that my pillion's back and my back were hurting, and I called the ambulance. I managed to get the contact of the witness and the plate of the car. I was then conveyed to hospital and my fren told me that tp came down to scene later.

 

My pillion and I were both discharged wit minor injuries and got 3 days MC. There was a TP IO who called me that she will need to have my statement the next few days after my rest. My bike was towed to TP and now I'm at a blur c*** of wat I should do next. I already lodged a RTA report with the police at a police NPC. My insurance is 1st party comprehensive. Guys wat do u think I should do next?? Need advices... The TP IO called me and infd me that this sunday i can collect my bike from the TP compound..

 

And lastly, my heart pain sia!!! My 3 mnth old spec III all jialt oredi. Want to cry but also cannot. Somemore when during RTA scene other vehicles were

At least I don't think a new bike like Spec III will have lighting/electrical problems. I hate idiots who tell lies to cover up their mistakes. Claim all damages against the driver, call the insurance company to find out what to do. I'm glad that you have no serious injuries, take care and get well soon.

No need to pay..

but try to check with ur insurance company 1st..

see if ur case is strong or not.

Usually shop will pay everything 1st then claim from ur insurance company.

 

Coz sometimes this rich people can twist turn story go lawyer

and end up u will be in the wrong.

 

Lucky u got witness. :thumb:

Follow up with all the claims with your insurance, less the other party want to settle your repair and medical personally. A witness is enough for you to bring the driver down to prove your right of way but don't get yourself into another problem by 'reward' him. Did not switch on the headlight is a lame excuse for S4V3, don't be surprised she came with tons of tale in her report.

1) my brother advised me to claim from my own insurance 1st, pay the ecxess amount and then ask from my insurance comp to claim from the driver. his reason cos my bike will be done up perfectly by better 'official' mechanics instead from the other shops... and if my claim is successful, my insurance will claim all the repair cost from the drivers insurance and my NCB will not be affected..

 

2) my friend recommended me a shop which deals with claims and damages and he said i do not need to pay anything. even like my body pains and taxi fares can claim from the driver. But i heard the claiming period will not be that fast. at least have to wait for 1 year...

 

So how guys?? Option 1 or 2? Which one better? :giddy:

you're asking a lot of questions that people have answered for others.

you've been shown a thread dealing with the same issue.

 

i think if you ask for advice, the least you should do is to read up on these threads here about what to do in a motor accident.

 

perhaps it would really help you to go through these to understand what you can do, and then consider what you should do.

 

if you're competent in handling a claim, go and get a lawyer or your workshop to get a lawyer to do it (if you trust their ability to do so).

if you don't have the time or the knowledge or the inclination to do this, claim against the first party insurance and let the insurer take over the recovery from the other party.

Wow! That woman is really one freaking bit*h leh.. First lights not on, now she say you beat the red light? If there's a witness, you have nothing to worry. The TPIO will always give you a grim outlook one.. So don't worry too much.

true...she is a blardy Daughter of a dog...if u win the case and somemore ur WITNESS can witness that the light is still green or u ARE NOT BEATING the red light...SUE HER for giving false statment and accusing u beating red light..this one the TP should handle BUT if they DON'T ... publicity out tell people how TP IO works and behave or handle ur case...SPIT at them if they can't do anything to that driver... PUIZzz at the driver for u first... :smile:

rest well.. such drivers should get banned from the road.. someone is injuried in such accidents because of her and she still can say that u were at fault for beating red light.. sigh..

the other motorist can say whatever they want to, just as you can say whatever you want to. it is normal that the two motorists in an accident will have different opinions of the event.

 

opinions are not the same as fact. it's up to you to make your case, and present evidence to show it.

 

if the TP were to accuse you of beating the red light, then if i were you, i'd put the TP to prove its case. the TP normally won't try these cases unless they have reasonably good evidence to make a case.

 

on the civil claim (for the injury and damage), it is likely that the liability for the damages will be shared in this case (as with almost all cases involving two moving vehicles). if you sue the other driver, then you will get a portion of the total loss, most likely anywhere up to 80%.

 

if the claim is highly contentious and there is no independent witness or other evidence, then if i were you, i'd suggest claiming against the first party insurance.
