i am a first year rider.

 

just received a laywer letter of a claim against me that suppose to happen at near of November.

 

the reason of the claim is "accident involving my vehicle due to my negligent driving, management or control of vehical"

 

claim amount is about 4.5K.

 

i am totally not aware of any accident that had happen or caused by myself. may i know how to i go from here? will call up my insurance company tmrw as the letter mention that they have submitted photos to them.

 

please advice.

You have to call up your insurer and inform them about it.

damn sianz... involve in something that i don't even know of. i thought i was already damn careful on the road.

 

not sure what evident she had. but if none it will be my words against her right?

 

but i think will be a hard fight for me since i am a first year rider and she had a lawyer to fight for her.

try recall if u had bumped anyone, small or big. it could be ur sub rider or friend who borrowed ur bike. just deny everything if u dont know of such incident. anyway call up ur insurance, any evidence submitted by them, u should be able to view too. ur insur agent should be able to advise u more. do not be afraid they have a lawyer n u dont.

Accident can happen anytime, anywhere.

However ask yourself, do you want to fall at 120km/h or 60km/h?

none. nothing at all. not even a side mirror.

 

i also do not have any sub-rider.

 

was advice to make a police report which i did. now can only wait.

 

hope everything turn out well.

then i dont know. perhaps the other party got the number plate wrongly. just check if the 'evidence' have ur vehicle or u inside, if not, just deny everything.

You can't possibly create a $4.5k damage without you knowing it.

 

In the lawyer's letter, there must be some details on the date and place of incident.Try to recall if you are indeed somewhere else, like in school or at work where you can prove your present, then you are off the hook.

 

Lately, so many cases of car with false registration plate, and you could be a victim of such fraud

my insurance company called me back to let me know they received my fax of police report and the lawyer letter.

 

they have also received the claim sent to them by the lawyer.

 

i ask for some details of the accident.

 

i suppose to have hit the car from behind. my bike suppose to be a black yamaha(mine is a blue/white). i suppose to have badly injure myself. police report suppose to have been made by me early on. nothing mention above is true to me.

 

i think it a case of wrong or false registration plate. major faint.......

wow, i'm guessing this is a major foul up by the other party. they must have gotten a wrong registration plate. a case of mistaken identity.

 

i've heard of such cases in other countries, but didn't expect it also happen here also. guess everywhere is the same.

yeah. i just hope that everything will be settle soon. not fun going through all these.

 

it a mistake that shouldn't have occur at the first place.

Can you counter-sue them by saying that the incident caused you to be depressed and wasted your time? Just wondering.

 

Because if i was in your position, i would really be worried.

imo not worth the effort, cos u need a lawyer n judge will think both party r just wasting his time.

 

unless u're a celeberity or earning millions in 1mth, can sue them for these trival matters, cos u're rich n the compensation could be up to thousands cos of ur status.

yeah. just want to get it over with. life is stressful enough for me now. 多一事不如少一事...

 

still waiting for my insurance company to get back to me. but from accident report submitted, most likely it is a mistake and everything should be fine.

Hah, I don't think the value of your emotional and mental distress is worth more than the doctor's and lawyer's fee you need to engage to prove your case of emotional and mental distress. and i think they calculate the value of emotional/mental distress based on how much you would earn on a normal basis.

TS, why u see this is not good? I see it as good, cos now u know that lawyer letter is not gonna cost u anything ($$$)... It is a good experience to learn. **** happens and u learned something and it is free (other than ur time)... most of use pay $ to learn u know...hahaa...

i spend $2.80 to fax the letter and police report over you know:p

 

anyway, it not not really due to a single accident like this that i count it as a bad experience. i won't even raise an eyebrow if that the case.

 

since 2 months back, things have really gone down hill for me. my wife is diagnose with cancer. thank God it was discover early so there is no risk to her life. currently in the mid of hunting for some low budget flat as we are not that well-off consider the mounting medical bills etc. to make matter worst, although my company is doing well, my department is not. so fear and uncertain is hanging in the air for everyone. i kept it from my wife as not to worry her.

 

thankfully she had got alot better. she might not be able to work soon for a period of time. i try to settle most of the major issue of our life by myself as not to make her worry as her health had take a toll on her emotionally. i have not waken up without a nagging worry at the back of my mind for a long time yet have to be as positive as i can as not to affect her. hope that it doesn't get worst from here. pray that i have the strength to ride over this period.

 

sorry to OT... just to vent abit.
