Thing is, did you collide the mofo that opened the door? If can get the particulars of all parties involved. If can get witnesses, try to get their particulars as well, if the mofo just run off, report hit and run lor. See who the one you scratch want to side with la, you and him can try to claim from the mofo but he can most likely claim from yours if he tried to claim from you. Easier if all is privately settled.

 

Got collide with the van or not? If yes then more complicated. If got CCTV nearby even better, try to get a copy of the showing the accident, easier to indict the mofo.

 

Keep in mind, the system here quite inflexible, mostly quite useless, they just blame who bang from behind sort.

 

If got injury, try to get MC 3 days +.

 

More importantly, you and your pillion ok or not?

if nobody mc more than 3 days, the first guy CANNOT be charged with hit and run even if you report him so.

 

the third guy DOES claim from you (biker). because his collision is from you. if it is decided that the first guy is at fault, you or your insurer subsequently claim the third guy's claim from the first guy. BUT there is a big possibility that the first guy may be found not at fault if a) he didn actually hit you, and/or b) you were found to be lane-splitting (squeezing) which looks like you were.

It's true: it's more fun to ride a slow bike fast than to ride a fast bike slow. Admittedly, though... It is MOST fun to ride a fast bike fast!

call your insurance and tell them about the case.. they will advise you how .. if he didn't ans your call.. take down all the date and time you called him and put that in the report.... die die go see doc first..

speed and be home 5 mins early or 7 days late.

From what I can see according to his graph if TS can prove the accident is caused by door opening he has a case. As far as I can tell you cant let off passengers in the middle of the road.

This case, very complicated. I think you just consult your lawyer regarding this case. None of us can really help you out here. From the looks of it, you are lanesplitting. The car which opened the door was stationary. They cannot drop off at the side because there are cars blocking its way.

first of all, i didn say it was illegal. but to answer your question, lane splitting can be be considered as either "Driving without due care or reasonable consideration for other road users" or "Reckless or dangerous driving". admittedly though, in singapore this charge is only slapped on you if something bad happens as a result of your lane-splitting, and ignored if you lane-split within speed limits and nothing bad happens.

 

you can argue the point, TP has never explicitly stated that lane-splitting is illegal (neither have they said it isn) and yes TP usually ignore lane-splitters within speed limits, but the fact is it can be done, depending on the circumstances.

 

i also will not presume to say whether TS shares any blame. based on his pictures, i am pretty sure the offending first car's act of stopping where he did is neither illegal nor unexpected because any car that wanted to reverse park into the car lot would stop exactly like he did. neither is it counted as 'middle of the road' because there is no lane divider. technically he is in the lane adjacent to the kerb, even though he is separated by a car lot.

 

i do agree though that the only point is the car door opening. it is not illegal or reckless for the car to stop where he did, but is it the car's fault to open the car door without checking, or the biker's fault for lane-splitting in that position. i cant say either way because i donno.

From what I see, you, the 2nd car can claim from you because your bike is the one whom bump into him. Unless you got witness to say the 1st car cause you to bump into the 2nd car, then the insurance company will throw out the claim.

i think you will have a hard case to fight since you are lane-splitting. i think you will need to share the blame for the accident since you are passing him without safety distance. the third car will surely be able to claim from you. it just how much can be done to put some of the cost to the first car.

 

as mentioned, call up your insurance ASAP.
