just got involved in an accident against cyclist. police report made, witness willing to testify for me saying that it is cyclist fault.

currently a NTUC 3rd party holder, are there anyway to claim against cyclist family or cyclist?

1) Protect yourself against his claim first. politely ask your witness to write/type a statement about what he/she witnessed, signed off and with contact details. when you make your accident report (which you must do asap for full protection, and this is NOT same as police report), include this as part of your report.

 

2) you can only sue the cyclist in court. you cant simply 'make a claim'. i do not know if your insurer has provision to do this for you, but i doubt it. especially if its only few hundred dollars worth. frankly only if damage goes into thousands with hospitalization fee and all then worth pursuing. after all, you want to sue you must engage lawyer first, and think about how much you have to cough up just to do this. you might win the suit and get back lawyer fees, but is all that hassle worth a few hundred bucks of damage?

You still need to inform your insurance within 24hrs.

you have to understand that an 'accident report' is basically you telling your insurer your side of the story, plus whatever evidences you have to back up your story. there is no penalty for not doing so, BUT if you do not do it within 24hrs like @ganman says, your testimony becomes less reliable if the cyclist decides to make some claim against you. and if your testimony becomes less reliable, then your insurer will have more difficulty protecting you.

 

dats why i said making this report is basically protecting yourself. if the cyclist does not attempt to claim, whether you make this report or not nobody cares. if you do report, it does NOT affect your premium. your premium is affected only by claims made against your policy.

U will kanna 6 demerit points failure to keep a proper lookout. He will claim against your insurance. i really hope it's not pedestrian crossing. No point getting a witness bro.

Your witness can only provide his account of the incident based on what he saw, and he is in no position to determine who was a fault. In most accidents, seldom one party is solely at fault so if the case lands in court, the judge will apportion the liability based on TP investigation.

Cyclists are not required to be insured but you can make a civil suit. If the cyclist is a minor or a poor man, whatever compensation awarded by the court will be a hollow victory since the defendant is unlikely to pay. In such cases, the judge will not award with cost, meaning you will still have to pay your own legal expenses.

 

The poor man may seek Law Society assistance and get a top notch lawyer to fight the case on pro bono basis.:)

 

Life in the sandwich class really sucks :angel:
