Recently a car driver knocked down my brother-in-law's CBR600, along with 4 other bikes..

 

But the driver had no license and insurance. The car belonged to his dad.

The police were alerted to this.

 

However since that guy has no insurance, how can we claim damages?

The guy wanted to settle the issue privately, but he has no money at all.

Total cost of repair for the bike cost $3000+.

 

Is there anywhere that we can file a claim or sue the guy to recover damages?

 

Any help appreciated, Thanks

Can claim from his father insurance right? By hook or by crook.. The driver is getting punishment for driving w/o license.. And The money that sums up for the bike repair, He's gonna find his way and return... Be it rob or steal.. If not his family gonna help him settle all this while he can clean his A** and wait for jail since u stated he got no $$..

Already call police, how to settle privately?

 

Seems in Singapore, insurance doesn't cover 3 things:

1. the uninsured - quite obvious, but there are always unlicensed drivers

 

2. the drunken

 

3. natural disasters - don't park under a tree during thunderstorms!

 

Take him to civil court or small claims?

You will have to claim property damage against the unlicensed and uninsured driver by suing him in the civil courts.

 

Now before you rush off to do that, he has already indicated that he's willing to pay you in a private settlement. So get a quotation for repair, and tell him that's the cost, and ask whether he's both willing and able to settle at that cost. If yes, then get a settlement agreement done, and get your money fast. That's a good settlement. Anything else, you have to consider what's in your best interest.

 

Go to a free legal clinic and speak to a lawyer for a brief review of your case, then you can decide how to proceed.

Lol.. and also thread starter state he got no $$ to pay.. So i say ask him clean his a** and wait go jail or He gonna find ways to get the $$.. Like sell away the car or bank loan or whatever sh*t he can do..
