Rider and pillion accident bcos of wooden plank on expressway

I need help here. 3 weeks back both me and pillion got into a crushful accident bcos of a wooden plank on the SLE.

 

We suffered abrasions but luckily no broken bones. But doctor said I torn my ligament and my pillion still waiting for her appointment. We were both hospitalised for 2 days and I received 2 weeks hosp leave while pillion received 3 weeks.

 

TP said owner of the plank cant be traced reason wise there isnt any camera on location. I didn't claim anything from my insurance, repaired my badly damaged bike with my own money cos no one to claim from.

 

Sadly, my pillion isnt working for 3 weeks and had no income due to the accident. Heard that she can sue my insurance to recover her loss. Any contact of lawyer that can settle this case for me as well as for her? Please advice.

Sure you can try claiming but she would need to engage a lawyer to sue the rider, and where is she getting the money to pay for the legal fee?

What do you think? She can definitely sue you. She can claim from your insurance but then your premium will definitely increase upon next renewal.

Your bike insurance cover you and your pillion. There will be no legal tussle for such case.

 

Do the right thing and ask your pillion submit claim to the insurance company. Hike in your next insurance premium payment is the last thing you shld think of...

or you can compensate your pillion yourself if you think your premium increase outweighs that cost.
