Hi all I need some advice from u guys , today I was riding along Ecp on lane 2 while riding suddenly a Volvo slow down and forced me to swerve to my right and at this time a lancer glx was there and my foot peg hit his car and left his after market rally rims some deep scratches and also some scratches along his bumper. Fortunately I didn't fall

 

Problem is I swerve to my right just a little at the lane splitting when I hit him. And he was real close to me we exchange contacts and he went to his garage and have a quote before I decide to settle privately or to insurance company . He don't have a front cam.

 

My question now is how should I settle it ?

What if he demand a unreasonable compensation ?

Was it all my fault ?

If I get my insurer to settle will I end up forking out cash to cover the excess ?

Will insurance over his aftermarket rims ?

 

Appreciate ur help guys

Just one aspect of your queries. Should u go by the insurance way, your insurer will go and check the cost of the repairs, which means he can't really demand unreasonable amount.

Plus, unless his own workshop is registered with insurance company, he needs to get a quote from an authorized workshop.

It depends on how much his repair will be vs. your insurance excess I guess.. If it's way higher then going by the insurance way is better I guess.. If not, just go private..

Just my opinion. Quite a sticky situation this.

Unlikely you'll have to pay excess for a 3rd party claim. Only applies to tpft or comprehensive.

 

So going the insurance settlement route your insurer should be covering everything. Just that next year you'll lose whatever ncd you have till this point. Plus you will receive a loading. No one knows what it will be other than your insurer. And you'll know when you renew next year.

So even the fault is mine I'm also able to claim ? Will there be any reason from me unable to make a claim ? Can I claim him ? My bike also have some broken parts

If it's your fault, you can claim against your own insurance if you have comprehensive insurance, not tpft or third party only.

 

If you wish to claim against him, you'll need to prove that his actions caused your damages. Will need to engage a lawyer to fight on your behalf or your bike shop might be able to secure you one.

 

Should your claims fail, you'll end up with the lawyer's bill on top of everything else.

 

So going by your description, if you are at fault, you'll have to bear your own repair costs unfortunately.

Do you have evidence that the car in front of you slowed down abruptly, causing you to swerve to the right? If not, its super hard to prove.

 

My take is to let your insurer handle.

Whether the front vehicle slow down, jam brake or whatsoever reason is it, you should able to brake in time if you keep a safe distance. Using "swerving" as a reason doesn't help you in your case.. Base on your story, IMO, you're at fault..
