i knock a slight dent into taxi bumper & my bike is nothing wrong except for my crashbar... stopped and hand signed cab to move to side together..

 

den another malay rider and his girlfriend ram into my back.. i flew forward and my whole rear is severely damage lights crack + car plate drop..

 

so like this taxi claim from me... and i claim from that biker??

 

but that biker blame me i nv on hazard light when i stop.. how to react!! 5 sec after i hit cab. there he comes and ram into me..

 

that cabbie is willing to be witness for me over this incase that chap try to prata something funny..

 

what are my chances of winning in insurance claim?? btw i am using NTUC coverage..

 

that fella call me.. to settle privately i pay for my repair... he pay for his repair.. what kind of logic?

i assumed there is no injury, so please go to IDAC the first thing tomorrow to make a report in case that somebody over claim or pushed all the blame to you, hope you got all the details/particular of the taxi driver and that rider.

 

meantime, go pull out all your insurance policy contract and go thru it, if not clear, call up your insurance company for the claim procedure for your policy. i do hope you understand what type of policy you bought so that you know what are your benefits.

"PLAN & COVERAGE

Plan and Coverage Sum Insured

1. Loss or damage to the Insured Vehicle caused by:

a) accident, fire or theft (for Comprehensive cover only) - Up to the market value, Subject to Excess

b) fire or theft (for Third Party Fire and Theft cover only) - Up to the market value, Subject to Excess

2. Death or injury to third party - Unlimited

3. Damage to third party property - Up to $500,000

 

EXCESS

You must bear the Excess specified in the Policy Schedule for all claims for accident repairs before we pay you.

You must also bear the following further Excess in addition to the Excess specified in the Policy Schedule:

1. $500 - if the insured vehicle is driven by a Named Driver specified in the Policy Schedule and Certificate of Insurance who is below 21 years of age or has held a full motor cycle driving licence for less than 2 years; and

2. an amount equal to 50% of the market value of your vehicle at the time of loss subject to a maximum of $2500 if your vehicle is stolen outside Singapore.

 

We will not pay for

(a) loss of use or any other consequential loss

(b) depreciation, wear and tear, mechanical or electrical breakdowns, failures or breakages

ok, now let me evaluate your situation:

 

- first, for your case, 3 vehicles involved, in the eyes of insurance companies, the rear vehicle which hit the front vehicle is DEFINITELY AT FAULT. taxi driver will claim you, ermm..wrong i would say it's the taxi company, and they are well known for big big claims esp Comfort, so be prepared for the claim Excess as mentioned above (i.e., to pay cash on your own which is unclaimable), your NCD and higher renewal premium....WAIT WAIT WAIT, if the driver got no intention to make claim against you, that is the BEST and that means case closed for you and him. if he does want to make a claim and the damage is minor, PLEASE call the taxi driver not to report to his company for the repair instead you will settle and compensate the repair with the driver privately.

TRY NOT TO LET THE OTHER PARTY CLAIM INSURANCE AGAINST YOU AS IT WILL AFFECT YOUR NCD AND RENEWAL PREMIUM.

 

- next, in my personal view and for your reference only so please do not quote me, thru the way that rider behaved and whatever he mentioned to you in the phone, it is obviously that he is threatening you because he knew he is on the losing side and his next year premium will be increased tremendously. after reading the contract of NTUC policy as a reference (which is almost the same for all insurance companies in singapore), if that rider is below 21 years old or less than 2 years riding experience, his insurance will not pay the first $500(at least) for his claim depending on his policy excess (i reckon that is the reason why he ask you to pay your repair, he pay his own repair). nevertheless, this will not affect your damage repair claim against him. if you or him call to settle privately, for me i would not do that unless he accompany you to the workshop tomorrow and pay the cost in full prior to commencement of repair, then i would settle the case.

TRY NOT TO LET THE OTHER PARTY CLAIM HIS OWN INSURANCE AS IT WILL AFFECT YOUR RENEWAL PREMIUM TOO.

 

- last and most importantly, if he still refuse to settle it privately, please by all means go make a report at IDAC (please confirm again the authorised reporting centre with your insurance company) WITHIN 24 HOURS and file up a claim against that rider for your damage repair. eventually the rider SURE has to compensate your damage after reporting, whether the rider or his insurance company pay. also, please mention the full accident including the taxi driver as your witness, this is the most important part and please go seek medical attention if required for any injury claim too.

Also, a POLICE REPORT against that rider for whatever things he mentioned to you earlier at the scene of accident and aftemath tele-conversation in full details with exact wordings, i.e., to settle privately you pay for your repair, he pay for his repair, asking his father traffic police to call you and talk to you, asking where u stay, blar blar blar...

The main objective is to protect yourself now in event if there is a drama later, as for his lame behaviour leave it to the police to decide whether to charge him for road bully or whatever crime.

 

PS:

If possible, settle all privately, no matter who is the claimant, all parties will most likely face a higher renewal premium and NCD reduction under current general motor insurance practise in singapore.

I would suggest to take leave today. Go make a report at IDAC with regards to the accident, Police Station with regards to the teleconversion between you and the malay rider. Please use the exact words to cover yourself if the rider doesnt want to pay for the damages and if case he "roti-prata" his words. If he got sms you, show the police officer the sms also.
