Bike Accident in TPE towards AMK

hi guys, i juz had a major accident on the 29/09/07 at TPE involving a car and myself. this is the scenario - i was travelling on lane 3(outer left) when a car who was travelling on lane 2(center lane) swerved onto my lane and cut through the chevron markings to exit hougang. as such, i hit onto his rear of his car as i was unable to break in time. Both me n pillion conveyed to CGH. there is an independent witness willing to come forward.

 

My 2.5mths old CBR1000RR suffered a total of $13000 damage according to surveyor. And the best thing is that I didnt buy a comprehensive riding insurance. Big Mistake.

 

My gf(pillion) suffered abrasions n a fractured ankle. She is under probation as she just started working and she is not paid if on MC. She is still on MC and more reviews are coming up for her which means more MC. She maybe dismissed for long term MC.

I suffered multiple abrasions, lacerations and Rotator Cuff Injury(right shoulder). My MC accumulate to a total of 19days. My rotator cuff is inflamed not torn which result in limited range of movement for months and needed to go for constant therapy. Im serving NS and CGH gave light duties for months.

 

1) Will I win this case?

2) How long will the TP IO sent out the result of d investigation?

3) As for claiming procedures, my lawyer is going to claim for my General damages and Special Damages. Approximately how much will I be getting for the compensation?

4) As for my gf, approximately how much can she claim for both General damages and Special Damages?

But now the problem is that the IO didnt wanna to take statement from the witness. He juz gather facts through the phone and if theres an appeal by the driver, then maybe he will need his statements. Even I havent been called for statement.

 

But I believe upon IO recommendation charge to the Attorney General Chambers, he has to submit all involved parties statements before the case can be pursued, as the AGC would need them for charging involve party.

Now its like there is no witness statement wich meaning to say, I have no witness.

 

Does it looks like the driver can only be released with a warning and case classified as 50-50 liability? Coz spoken to an experience TP who is a fren of my dad, he said all bang at the back case will be 50-50 unless there is a witness. As for benny case, he banged at the side which made it a clear cut case.

 

Im concern abt the investigation result than the claims.

I was involved in an accident in July 10 2007

till now, tp has not take statement fm me yet

 

Fm what i gathered, such cases usually take ages... easily 6mths to a max of 3 yrs

 

Unless the TP give verdict, yr medical report is out, yr lawyer cannot do anything

 

I suggest in the meantime, just rest n recover and move on with life first

If you don't have motor shop or lawyer to help, you may want to consider put your case to Glenn Motor along Serangoon Road next to GHC.

 

Afew years back, I had a minor accident with a car, about the same scenior as yours. Glenn motor had handled the case for me, won the case. It took about a year (got to be patient).

Bike repaired and got back some money from the other party's insurance company.

Get a lawyer now, record the statement. Makes life easier. Most of the time the lawyer's fees can be recouped from the insurers.

bro luckily u have a witness, if not its an almost lose case because u hit him from behind, pple twist and turn facts to save themselves, this world has whatever kinds of lansai pple. claims will take a period of time... TP will be involved one la, maybe u can get shops specialize in claimings to do the repairs for u first... so that u dont have to pay for the repairs first. Hope this helps.

Usually statements of all parties are supposed to be recorded as soon as possible, while the recollection of events leading up to the accident are still fresh. Maybe I'm wrong, but being a witness to a serious accident case before (near-fatal), my statement was recorded within 3 days, and that was after the IO called me and discussed a suitable timing for us both.

 

Maybe that was because there was a 50/50 chance that the victim might pass on, so there was some urgency. For your case, try to direct your questions to the IO in-charge. Ask him on why statements have not been recorded. Ask him aren't statements supposed to be recorded while the memories of all parties involved are still fresh.

 

If he's still uncooperative, talk to the OC in-charge of your IO's Investigation Team. Tell him your predicament and your concerns on the likelihood that if proper procedures were not followed, you might lose the case and have a lot to lose.

Ive already engaged a lawyer.

 

Now prob is that statements have not been recorded. Except for the driver involved. As for witness, itz only through the phone.

 

I called my IO juz now and asked him abt the outcome of the case. He ask me to wait for traffic police letter sent to my hse and he don't need my statement FOR NOW.

 

Really dont know what is going on.

my fren involved in similar accident like yours.

car swerved from 2nd lane into filter lane, turning left.

my fren, riding rxz, was on 3rd lane, going into filter lane too.

 

he hit her car, at the left hand side of boot area. damage was est 5cm dented boot and long scratch.

got independant witness also. saw the whole accident, saw the woman driver at fault, last minute swerve in to turn left.

 

initial conversation, she agree to pay in cash my fren's bike repairs.

very cheap only, just headlight, head fairing, clip-ons, front fenders. confirm

 

next day, my fren and i were at ah boy, waiting for her to come down and pay for the parts. when we called her, she pass the phone over to her colleague who spoke on her behalf and insist that we just claim insurance. i was too kind hearted and even persuaded them, just do own settlement. her not so bright colleague who sound so bloody stuck up stuck to his claims of "who's gona pay for her damaged car?"

 

oh well, cut the story short, i brought my fren to jimmy @ mayo st and let him settled everything. IDAC, surveyor, claims, laywer, etc.

 

result?

the driver kena fined by TP + demerit points. dangerous/reckless driving i tink. cant remember. sorry.

my fren got abt $4K in cash aft deducting lawyer/shop fees.

yeah, same stuff, general and special damages.

Ouh. OK. But do you know whether the TP IO took your witness statement?

Also did he took your statement and when did he took it since the day you reported??

 

Lastly, how long did you waited for the verdict from Traffic Police?
