was lane splitting to get home in heavy traffic and was inbetween a truck and a car, truck on the right

 

The truck moved a little to the right and I wanted to avoid so i swerve a bit to the right and hit the car mirror.

 

The mirror bent forward and the driver made a very big fuss about it even though it could be pushed back to normal...

 

Exchanged particulars already.. so how?

 

Driver threaten to make police report if i dont pay the full repair amount.. If police report made, will I get any demerit points or fine or any problem?

 

I checked the demerit points website, 6 points for careless driving and 9 points for "Driving without due care or reasonable consideration for other road users"..

 

Because still p plate, and from what i know, police report is only needed when there are injuries

 

Not concerned about the truck anymore because by the time i stopped, the truck was gone already

 

Just want to know if anyone has been in this situation, any demerit points for hitting side mirrors?

 

And also how to deal with this..

First of all, the fault's on you cos you choose to "move close to another vehicle without maintaining a safe distance" by lane splitting, so it's your fault for hitting his mirror.

In short, if he wants money, ask him to get it from your insurance, hence you need to contact your insurance to cover your backside in case of exaggerated claims. Best thing is you have taken the photos of the damage on the spot.

@kaiq has established that you are likely at fault.

 

So to add a perspective from practical experience - this is what I recommend:

1. If he insist on you making payment for repair, ask him nicely to go to workshop together on the spot to ascertain the damage and cost of repair

2. If less than your insurance excess, then just pay him off. But can try for a nibble to lower the component paid la...this depends on your nego skill

3. If more than insurance excess, it depends on how much more, whether it is worth the increase in premium.

 

If he doesn't want to go workshop on the spot, suggest a time to meet up with him to go together. If you don't want the hassle, then get him to go to the workshop and let you know how much (but typically for the 2nd option, workshop will inflate the claim and sometimes split with the driver, though this is illegal it is hard to prove).

Just be mentally prepared that car repairs ain't cheap. If the mirror is the folding type, and the mechanism inside got damaged, probably over 100 bucks.
