Hmm, this has gone on in my mind for sometime, and unfortunately, it happened to my mother recently. Not about bikes la. But I have never known, say when your bike parts are stolen, then you call police, police is able to catch the theft, he confessed everything and that he stole the parts and still has it with him, he will be charged by the police right? So will the police make him give you back your bike parts?

 

Because my mother was doing some ATM transfer, then the machine asked if she wanted another transaction, she absentmindedly just walk off la. Then there was this fellow behind her, just took advantage and transfer/withdraw $200 out of my mom's account, I not sure, will ask her.

 

So police report was made. Indeed, the CCTV capture what happened from my mom's turn to the fellow's turn, and he was caught. Upon questioning, he confessed everything, so the police fined him. They sent a letter telling my mom he has been charged and fined $1000.

 

Then....my mom asked them about her $200. They say they cant do anything. So...what is really happening here? If the offender has to pay $1000 in fine, but no need to return at least what he stolen from my mom, it is kind of weird ley. My mom was so angry, she thinks next time don't call police also better. I don't know about all these, so maybe someone here can enlighten me?

Didn't even give $200 from the $1000 fine to your mom???

 

That is as good as government taking in stolen property, because the $1000 fine should be considered including the stolen $200 in it!

In order for ATM transfer, doesn't an ATM card still need to be inserted into the machine? DId you mom removed her ATM card from the teller machine or did she entirely forgotten about it?

 

I think next time should ask the police to fine the culprit $1200 instead so they can return the $200 back to the owner.

Ask the guy to return your mum $200. If not, sue him. Since he has been charge and fined, he defi will lose the case. And I believe you can claim your lawyer fee (if you had won the case) from him.

what crap they cannot do anything? they can fine the fella but cannot ask him give back, when the thief already confessed. something is really wrong with the police force.

bro honestly this thing depends on what goes in court meaning what the prosecuter and judge says..as of what i know is if the item stolen is something other then money and its a evidence which the police is holding on to they'll be ordered to return to the victim after the accused is charged.bt as for money from i can guess is if the money was with the accused when he's caught then court will order the money to be returned to the victim..please correct me if i'm wrong just sharing what i know..

My opinion: If the person transferred the money to his account then perhaps you may call or visit the bank to inform them of the issue (also don't forget to bring along the police report) maybe they can assist in recovering the money. Does your mother have the person's particulars? It would be easier if she has them.

 

However, if the culprit withdrew the cash then perhaps get his family members to return the amount to your mother as peacefully as possible. Suing the person could be another alternative but make that the last resort.

The machine she used was the cash deposit machine, so whenever you're done with depositing or something else the machine will just ask you if you'd want another transaction, that's when my mom blur blur stepped off, but she turned around a min later, realising the mistake.

It has never been clear about such issues, because I think we only hear things like, if you lose money, go to the police. They never really state that they will help you recover it, if its recoverable. Yet you sought your own methods to recover it, you'll be like illegal. So...it's so hard to work around things when you are careless. Just like to share this with bros here, and spread the message, don't be careless ba.

What a legal way for government to makan money from us :dot: I think TS should speak to ur MP with the police record, get an explaination. :faint:
