Accident with a Malaysian car. I need help cause im a p-plate rider

on the 29/04/2011,i was riding my bike along woodlands center road towards street 41 to send my order. When i was going straight and the light was amber and ive pass the white line. From my view i saw this car was stopping and then inching forward to make a right turn covering my path of going straight, i did brake slightly because i tot she saw me... but eventually she didnt saw i was coming.. so i decided to swerve to the side to avoid hitting herr car. I manage to avoid but i crash to the side road. When i was up from the crash i did saw the car stop, but she just drove off like nothing happened ! Luckily one singaporean driving followed herr to her placee. A few minutes later the singapore guy came back to the accident place, and told me whether i wanted to know where's the car was at. so my friend followed him. All the witness know that the car made a right turn when there was no right turn arrow. the junction have no right turn pocket. Now i did made a police report.. whats the next step i need to do ? pls help.. tq soo muchh..

hope you have all the details of the witnesses especially the singaporean driver that follow her and the malaysian driver plate number.

 

did you manage to speak to her?

 

next step is to contact your insurance company and submit all the relevant details and document(Police report) to allow them to make a claim for you.

 

good luck and hope you didn't suffer and injury.

i did made a police report. But the main thing is I didn't hit the car.. Cause I manage to avoid Herr..

bro, i kana same thing as you before but i never go make report. Because nv contact with the car means no accident, treat as a lesson learn n slow down when coming to junction.

TS, you can make a claim since your accident was due to her alleged negligence.

 

First and foremost, I hope you have the details of your witness.

 

Next, make an accident report. You can do this at any bikeshop that does insurance claim or at IDAC, but be sure to ride/tow your bike there as pics of damage needs to be taken. If you have not made a report till now, you will be penalised 10% off of your NCD for late reporting. Please do not let this penalty stop you from making a report cos 10% on a motorcycle premium is really not much as compared to the damage claim that you may recover.

 

Here's the technical part: Is your insurance a comprehensive plan or just 3rd party? If it is comprehensive, you can claim your repair cost under your own insurance first, which we call OD in the industry and then your insurer will commence a subrogation claim against the 3rd party. This whole process may take quite some time, especially since the 3rd party is a foreign vehicle. So, be prepared that you may pay higher premium for your next renewal first if your case is not yet settled. Should your insurer subsequently be successful in their claim recovery, they should reinstate your original premium and refund you the extra that you paid.

 

Now, if you only have 3rd party coverage, then you will have to pay for the damages on your own and subsequently make a claim from the 3rd party. Once again, since 3rd party is a foreign vehicle, your claim will have to be done through a solicitor as you have almost no avenue or knowledge on the 3rd party's insurer.

 

You were correct in making a police report. A police report has to be made in all cases that involve a foreign registered vehicle, a hit-and-run case or if any party suffers an injury, which is basically almost all motorcycle accident cases. If the 3rd party had come into contact with you, she would most likely be detained by the police at the checkpoint as it would constitute as a hit-and-run, which is a criminal case. However, since there was no contact, she can very well deny or at least claim that she was unaware she was negligent.

 

Having said all these, it does not mean you have a sure win case. The absence of damages on the 3rd party makes it more difficult to claim as the 3rd party can deny the allegation. To add the icing on the cake, it is a foreign vehicle, making it impossible to claim at times as the 3rd party does not have insurance. However, since you have an independent witness, you do have quite a good chance of a successful recovery. Just pray that the 3rd party has a valid insurance :p

 

Other than the above, you may wish to google for Motor Insurance Bureau. They assist victims in ex-gratia payments where the offender cannot be traced or does not have a valid insurance. I must however state that I am unsure to what extent MIB is willing to assist you so don't put your hopes on this method.
