Three lane road near Sentosa. I'm on the fast lane (by car). Lanes are not merging so there is no real reason to change lanes. Car in the middle lane wants to cut into my lane but there is no space. He cuts anyway. I horn but don't brake. He keeps coming and I don't give way so we touch.

 

We both stop. My front left scratched. His right back scratched. Both maybe 500 damage at a local paint shop. We exchange phone numbers and both make pictures.

 

I texted him that if he pays my damage I consider the case settled. He replied that we both should pay our own damage. Alternative is to file report and let insurance sort things out.

 

I feel I had the right of way. I was in my lane and there was no space. He forced his way. True I did not back off but I also don't want to get muscled by a big black BMW who thinks he can have his way.

 

So who's at fault here? I mean what will insurance decide?

 

Any ideas how to handle this?

Report to your insurance company first.

inform your insurance, make a police report, make a trip to IDAC for inspection and pass all documents and details to your insurance. patiently wait for the result.

 

you have the right of way so chance are you will win or at least less responsiblity for causing the accident. of course the other parties will try to shift the blame to you. do you have a video of the accident?

No but I do have a witness. Someone driving behind me who claims the car in question tried to cut in front of him first but failed, then overtook me and tried his luck with me. Still wondering why he was so desperate to get into my lane. There were three and all were going at the same pace...

 

Was it worth it...? Not really but I hate the fact that big expensive cars always think they have more rights. So I defended mine.

 

On your advice; can we still settle outside insurance even though I inform them and file a police report?

Yes. You have to inform ur insurance company no matter what. Btw if there is no injury sustained, no police report is required.

that is by right...

 

my insurance guy told me to make report if there is claim. making a false statement to police is chargeable offence. it suppose to give your statement a little bit more weight if there is a case to fight.

 

i take what he say for what it worth. up to one to decide. but i do every bit i can to win the case:cheeky:

submit your witness details to your insurance company as well if he is willing to help. that will make a big different:thumb:

 

all i can say is two wrong doesn't make one right. to a certain extend, i do believe in today world, the rich does in fact have more privilege even in Singapore. that just how the world goes no matter how unfair it is but that another story. most important is we are able to go home safety for our love ones isn't it? to each it own.

 

nope. apparently he doesn't give a hack on what you do. so your choice are limited to what the other driver say. either you repair on your own or claim through insurance.

I reported the accident to my insurance as advised. Police report was not necessary. Police report is only needed when:

 

1. Somebody is injured

2. Government property is damaged

3. A foreign car is involved

 

The accident was registered as "report only". That means I'm not claiming yet but am free to do that at a later moment. So we can still settle without insurance OR I can submit a claim against the other at a later time.

 

Anyway, we settled the matter today privately so no need to take it further.

It's best to get some written documentation stating from the other party that he or she will have no more further claims against you
