I am in an atypical situation and maybe some advice is appreciated.

 

I parked next to another bike at 5pm in an HDB open carpark, next to HDB blocks (visiting a friend). We went out and came back at midnight, and there was a police car with 2 officers. Both the bikes were lying on the ground. They received a call some 30mins earlier.

 

Upon closer inspection, the other bike has a flat tyre. It has been parked there for ages - due to the dirt around the tyres and the condition of bike. My bike was scratch by the other and also small ones on the other side where it landed. I checked his bike and no signs of being knocked by another vehicle. His bike just toppled over when it lost balance when the tyre slowly deflated.

 

I made a police report the next day (upon advice from the policeman). When I went to the IDAC to report the incident, I discovered that bike was laid out - no insurance coverage nor valid road tax. I tried to get the owner's contact from the police and of course unsuccessful. I contacted LTA and waiting for their reply.

 

That means I cannot claim against his insurance company (non-existence) nor mine (third party coverage).

 

I sent my bike for repairs, and the quote for the mudguard and fairing is at least $400. My bike is a sports tourer.

 

I do not wish to seek legal action as it is a lose-lose situation. Throwing good money after bad.

 

I could put a note on his bike to contact me, which I'd probably be ignored. I cannot be on a constant lookout for him as I dont stay there.

 

Is there another way to get his contact, in case LTA response is negative? I would rather speak with him and offer him an opportunity to take some responsibility by bearing part of the repairs.

 

Or any other suggestions for consideration?

small claims tribunal does not entertain disputes involving motor vehicles.

this is neither an insurance claim nor damage caused by use of motor vehicle. this should be damage to property by respondent so i don't see why you can't go sct

it's not act of nature. it's negligence because the bike fall was caused by the flat tire, which the other party should have maintained.

 

Sad to say its difficult to prove the tire deflated by itself. It could have been deflated before he parked it.

how to prove the bike deflated and fell over??

could it be some one ..some thing ..move the bike??so u see 1001 causes and no culprit..

let me tell you a story about proof..

 

one day..there was some problem between 2 car drivers..

at a red light stop..where 1 car is behind the other..

the car in front suddenly reverse and smash into the car behind...

off course both reported to their insurance coy..guess who won the case??

there were no witnesses or cameras..just by the written report of the drivers

The civil world go by evidence, bro, not by story however true it will be. You have to back it up. A motorcycle tire can be flat for both, but how it going to topple over in first place.

Anyone can ride a bike. Being a biker, is a state of mind.
