Hi fellow forumers,

 

I have a bad encounter which this fellow forumer called Motorrad202, hp no 9180 xxxx . I wanted to point this out to serve as a warning to others about his integrity.

 

This malay guy was selling his nokia E71 on the forum and i arranged to meet him to buy the phone. He told me the phone is like new without any scratches and use for 2 mths only. He did mention it didnt comes with box and warranty which i accepted and we agreed on a mutual price to deal. When i meet him up at yishun tonight ard 845pm, he came inside a car at the taxi stand, with the wife beside him and her wife passed me the phone. He told me that he needs to rush back and cant stop at the taxi stand for long and called me to go home check the phone and call him if anything wrong. As the lightings ard the taxi stand is poor and thinking that he needs to rush, i didnt check thoroughly as i trusted his words. Since i manage to turn on the phone, i trusted his words thinking that he is a veteran in this forum so i handed him the money immediately.

 

But after he left i went to check the phone immediately and thoroughly under the light and to my horror, there is a small crack and minor paint wear at the bottom, and the battery inside the phone is not original which he never mentioned to me at all. I wanted to return him the phone straightaway or demand a refund so i sms n called him immeditately. He never reply my sms or phone calls. I think he should come out and resolve this with me asap. He stills owe me an usb cable which he forgot to bring too. He did sms me back to call me give me my address so that he can mail the cable out. I dont dare to since i have lost trust in this guy.

 

I am very disappointed in his dishonest behavoir and loss of integrity over this matter, despite being a veteran in this forum. I hope he will contact me soon and resolve this matter personally.

 

Up till now you have not sms me your address. Not my fault and stop blaming me. Gave you ample time to check the unit. Nobody rushing you. Yes I forgot the data cable but you refuse to sms me your address for what? Scared of what? For all we know you dropped the set and claimed there was a crack. Set was in good condition when handed over. Yes my wife was the witness that you received it in good order.

 

I will not hesitate to take legal actions for putting up my details here. TRY ME!

Initially when confronted by buyer, seller made subtle attempts to portray the buyer to be a shady and indecisive person to buy over pple to his side.-->accusations of buyer not smsing him his address. Throwing open hints that the buyer is afraid of confrontation with issue/things to hide.

 

Then proceeds to paint a different picture of the sales event by lying that buyer damaged the set and wanted a refund. Tried to make himself to be an honest and open sales person by pulling in an non-neutral/partial party to vouch for his sales.(His wife.. oh come on man...)

 

Yups and this dude wanted a refund after he took the phone for almost 15-20mins. Anything could happen for 15mins..gave him ample time to check and now asking for refund. If you bought a bike and crashed it after leaving the shop would you be able to get refund? Think... o_O

 

 

where got 15 min? i msg u immediately at 848pm, i still have the sms with me

 

 

After further attempts to paint a different picture and give false misleading facts about the proceed of the sale, when the buyer said he kept the sms with the time stamp imprinted as an evidence,

 

 

THE SELLER IMMEDIATELY SHUT UP AND MADE ABSOLUTELY NO MENTION OF THE ABOVE SLANDEROUS STORY HE COOKED TO THROW BUYER IN A BAD LIGHT.

 

 

no i didnt change my mind in buying this phone, but your phone stuffs arent original as it came with the box. The battery is not original nokia which u nvr even mention to me at all, the leather case, earpiece and charger are different models that doesnt came originally with the phone. Obviously u took other nokia phone's accessories and gave them to me. But i am not fussy about the earpiece or the charger. The battery and the crack is unmentioned to me which i am fussy about.

 

Dude,you checked the phone, and willingly passed the cash after your inspection. Why didn't you say about the things you weren't happy on the spot? And now all these slander.. :dot:

 

like i said the place is so dark, how can i see properly. somemore u mention if got anything wrong i can get back to u of cos i trust u and handed the money to u dude. Most importantly u parked at the taxi stand, u dun even wana come down of ur car to deal with me. obviously u wanted to move off fast and i dun want u to road hog at the taxi stand.

another thing about this phone, it comes without nokia singapore warranty sticker, unlike the phone at the bottom. i believe this phone is export set.

MOTORRAD202 don't avoid my questions leh... how come u dunno hw much u paid for the phone? how come after 3mths, u don't have the box n warranty? which starhub shop? get the IMEI no. can find out whether u bought it there.

 

I merely follow the ever changing price listed in the papers. It may even be lower price now for all you know..why S'poreans like to kaypoh and be "nasi tambah" ah?

 

Nuff said..Good God knows if buyer replaced the set with his faulty one after purchase. Slander...

Seller once again evaded all the loopholes discovered by other by making insinuating, digressive irrelevant remarks such as "calefare" , "Try Me" "Junkie" etc etc etc..

 

Most glaring loophole uncovered by other, seller said he is selling a phone he bought himself.. in the last remarks i quote him saying now tat the phone is GIVEN by his ex boss.

 

Why this affects the sales is that at the initial point of sales, seller has to present the facts on the details of the merchandise to market and offer to the buyers.All these constitute to an OFFER made. Buyers will make an ACCEPTANCE based on the details of the offer made. OFFER & ACCEPTANCE, deal is made and transaction is legal binding if neccesary.

 

but by this display of self contradiction and lack of proper supporting evidence to substantiate the condition of the phone made out in the initial OFFER is sufficient to warrant a MISREPRESENTATION. All stated in the fundamentals of contract law.

anyway just to let u know that ur phone indeed has a dent and small crack at the bottom which is 100% not caused by me. U might have drop it once before and u didnt remember it. Anyway i will sms the address shortly. But i hope u can refund me some $ on the cosmetic defects and settle it once and for all.

 

Wa steady le you..from $400 I reduce to $368 and now coming up with some more pattern to get further reductions.. :dot::dot:

 

 

Furthermore later on.. despite ppl uncovering his lies and deceive, he still tried to make a desperate attempt to smear the buyer & place himself(seller) in a more honest light by suggesting that buyer is kicking up a scene to get further price rebate...

 

elloz.. buyer is asking for a REFUND and TAKE BACK OF PHONE.. since seller chui pattern dun want to take back cos it be harder for him to sell in light of the matter being blown up & let known to more pple,( * Ok I'm being excessive subjective in this para*)

 

the more appropriate and politically correct interpretation of the above should be:

 

 

BUYER IS NOW TRYING TO SEEK COMPENSATION FOR DEFECTS THAT SELLER INTENTIONALLY HIDDEN DURING THE SALES, SINCE THE SELLER DID NOT MAKE GOOD & INTENTIONALY LIED/MISLEAD ON THE CONDITION & SOURCE OF HIS GOODS SOLD.
