i was wondering..

 

what if theres a situation where this person is blocking your way (pedestrain). maybe an old person or sum1 with heart problems. then u horn to let them noe theres a vehicle behind them. then when u horn, they get heart attack and die. will it counted as murder?

Just reminded me of an incident today. Was driving along clementi ave 2. Saw a middle age lady and whole family, children and grandma i think.. I was wondering wtf is the lady walking on the right side of the road and not using the center divider. Same goes for the rest of the family. So i just hit my horn and slowed down dramatically as got elderly and young children crossing. Damn, there is a overhead bridge right ahead and they are not using it.

put yourself in their shoes, be it the grandma or children. Would you use the overhead bridge yourself?

it depends on where the "block" happens

 

if the person is jaywalking, den fine, die oso no problem

 

if the person is inside the designated crossing area (eg zebra crossing) and u horn (provided the person die), u die

 

however

 

if you horn the car in front of you (for watever reason) and the person walking on the pavement or at the bus stop hears your horn and die, den it's not ur problem also

 

reason being, do you own the person a duty of care?

 

in applying this, we need to look at the neighbour test. it means we should all have a duty of care not to hit someone who is considered a neighbour to us (eg sitting in a cinema and the person next to you is considered your neighbour)

 

in scenario one, since she shouldn't be jaywalking in the first place, you still have failed the neighbour test. but in applying strict law, you committed no offence.

 

scenario 2: straight forward case

 

scenario 3: it is not reasonably foreseeable that the person will die upon hearing your horn at the bus stop nearby, therefore failing the neighbour test.
