24 Demerit Points Offences

24 Demerit Points

 

Exceeding speed limit for vehicle by more than 60 km/h.

Exceeding speed limit of the road by more than 60km/h.

Reckless or dangerous driving.

 

Offender will be prosecuted in court.

Court Penalties:

 

1st time offender- Fine not exceeding $1000.00 or jail sentence of up to 6 months or both.

2nd or subsequent conviction- Fine not exceeding $2000.00 or jail sentence of up to 12 months or both.

 

Dangerous Driving

The Law – Section 64(1) of the Road Traffic Act Chapter 276 states:

 

“If any person drives a motor vehicle on a road recklessly, or at a speed or in a manner which is dangerous to the public, having regard to all the circumstances of the case, including the nature, condition and use of the road, and the amount of traffic which is actually at the time, or which might reasonably be expected to be, on the road, he shall be guilty of an offence under this Act and shall be liable on conviction to a fine not exceeding $3,000 or to imprisonment for a term not exceeding 12 months or to both, and in the case of a second or subsequent conviction to a fine not exceeding $5,000 or to imprisonment for a term not exceeding 2 years or to both.”

 

Section 64(2) of the Road Traffic Act states:

 

“On the second or subsequent conviction under this section, the convicting court shall exercise the power conferred by section 42 of ordering that the offender shall be disqualified from holding or obtaining a driving licence unless the court, having regard to the lapse of time since the date of the previous or last previous conviction or for any other special reason, thinks fit to order otherwise, but this provision shall not be construed as affecting the right of the court to exercise the power aforesaid on a first conviction.”

 

Section 64(4) of the Road Traffic Act states:

 

“Any police officer may arrest without warrant any person committing an offence under this section.”

 

Examples of Dangerous Driving

a) Failure to conform to the Pedestrian Crossing Rules resulting in pedestrians taking evasive action by stopping abruptly in their tracks or ‘jumping back’ to avoid being collided into;

b) Sped (exceeding speed limit by 20 kph) through a junction against the traffic red light signal resulting in other vehicles having to take evasive action to avoid a collision or a near collision;

c)

 

(1) Cutting across double white lines, or

(2) Overtaking in the face of on-coming traffic,

 

and forcing on-coming vehicles to take evasive action to avoid a collision or a near collision;

d) Switching lanes repeatedly at speed well exceeding speed limit by 40 kph without signal or driving in a zigzagged manner at speed exceeding limit by 40 kph, and by so doing encroached into the path of vehicles resulting near collision with these vehicles;

 

NOTE: These examples are merely illustrative.

Every situation is assessed factually on a case-by-case basis and the evidence available.

 

I'm opening up this thread for people who has been or is currently in this position so that we can share experiences and guide what to do since anyone who would be in this position would panic and get worried.

I strongly believe every person deserves a second chance. Personally, I've been through this situation and not a single thread could point me to the exact information that i was looking for.

The closest information that I could absorb from is this thread which only carries 18 Demerit Points and a lot of whining, flaming which will not help anyone in that particular situation. Therefore, I'm opening up a thread fresh specifically for 24 demerit point offenses. If you belong to other than 24 demerit point offenses, you should probably go here. I will be spending some time helping you out by answering questions and clarifying some doubts based on my experience.

 

18 Demerit Points

Exceeding speed limit for vehicle by more than 50 km/h up to 60km/h.

 

- Reckless or dangerous driving: Even if you hit a pedestrian on a zebra crossing you are liable to fall under this category.

Note: For Drink Riding/Driving unless you are celebrity or had really strong mitigation factor, most probably your license would be revoke.

There was this case involving someone from church either a priest or a pastor, his mitigation was helping e.t.c. He was spared from getting revoked.

I find TP., LTA officers speed so often. their reasons: attending to urgent matter especailly escorting VIP. how??

 

That's the flaw especially when they're off duty with their own vehicles.

I read through the 18 demerit points thread you highlighted. Didn't find much information. If I'm given 18 points for a speeding offence. And I am a first time offender with 20 points left to spare. What will my charge be like? A fine not exceeding what amount? Any jail time? I am still awaiting letter for my court date.

 

And another issue is. I was travelling in KPE this noon. About 80km/h. Then I saw a flash of light over my head which was very bright. And no cars overtook me or around me. How soon will I know if I was caught speeding? Because I travel at the same speed and same stretch in KPE everyday to work and only today did I see a flash. Help....

If it's 1st time offense suspended but again it's case to case basis. Care to enlighten me what happened?

1st time offender for 18 points usually warning but yet again as i sat in court the other day waiting for my turn some are suspended for 2weeks-3months waiting for the letter can be very long i received mine 1 year 3months after my date of offense and through intensified appeal to Traffic Police, AGC, i was prosecuted 2years later. Exceeding 10 is 4 points if im not wrong but i had a friend who traveled at that speed and saw a flash too but waited over 2 years now nothing probably the camera is full or a glitch. By the way the summon for 18points shouldn't exceed $1000 for my experience hearing all such 12-24 points cases in Subordinate Court (21) is $600-$900 i myself was given $900 and a warning from the Judge, a week later Traffic Police send me a letter to suspend my license for Four weeks which is one month and go for a refresher course. Worst of all the Ferrari case make future speeding cases no chance of appealing.

As for your 18 demerit points, I think we won't know until you attend the court and see the judge give you what kind of punishment? For KPE, speed limit 70km/h, so maybe is 4points + $130..

Thank you all so much for your help and clarification. I must admit. I am very remorseful now that I have been charged with this offence. I have been holding my 2B for 5 years now and just so happen I was late for work that day and decided to rush a little, I got clocked. Hais. I never usually speed and this is my first speeding offence. Usually my points is because of illegal parking or cut double white lines. I hope that the judge will be lenient and I get to keep my license. If I lose my license, i will lose my class 3 too, and there goes my job as a driver. Nah, i think you probably will be suspended less than a year more than 2 weeks... don't think so much. I was on your shoes so i know.

May i ask say, if i were to commit a offense that cause me to have a deduction of 6 demerit points say today, 28 June 2012, and i am still in probation period(p-plate), when will my point be refreshed? 1 year from the offense date? or every year from the day i pass my license?

Maybe a bit side track. But illegal parking will get points ah? Didn't noe tat.

 

I ve held my license for > 10 years and yes i kanna illegal parking maybe 5 times? But never had pt deducted before.

Since you're still under P-plate, you have a maximum of 12 points to be deducted before you are suspended. This limit will be raise to 24 demerit point once you have your valid licence for a full year. This is regardless of any amount of demerit points you might have incurred as long as it is 12 and below.

 

However, you will be reinstate to the maximum available limit only if you maintain a offence free record for 1 year from the time of your most recent offence. Which means that you will have 0 demerit points to your licence on 28th June 2013 if you do not commit any offence during this 1 year.

dun worry la TS , i see ppl who got revoked of their class 2 but keep their 2a and 2b and 3

so in yr case, maybe u get to keep the class 3

if it so happens ,pls buy 100piece of kfc for the orhapnage

Hi Buddy I sent you an earlier msg but I think it did not go through. I am messaging you with regards to your post on 24 demerit points. About a year ago I was caught speeding and was clocked at 153 KM on a 80 KM road. It was late at night and I was rushing back because my wife had a small fall and she was pregnant at that time. I tried to plead with the officers and since I did not receive anything over the last year I thought maybe they gave me a chance.

 

However I received the registered notice today to attend court late May. I am trying to look for as much information I can about such cases as I am very worried I will lose my licence permanently or even be given a jail sentence. I am ready for a suspension and a big fine as I deserve it because it was my fault ultimately.

 

I understand you went through a similar case. Can you please share your thoughts or your advice. Will an appeal process through TP help. I have some memos from the doctor stating my wife had a fall. Will that be helpful in mitigation. Will I lose both class 2/3. Any ideas or advice will help me greatly. Thank you very much.

Hi Bro... I have charged 6 demerit points for speeding in Aug 2014. Yesterday I TP caught me given 12 demerit points. i am waiting for the letter from the court. I know it is completely my mistake. What should I expect in the court? Fine or Jail? How long I have to wait for the court formalities. I am bit scared. Any advice? Thanks
