complaint against LTA

hi guys.. need some advice here.. i met with an accident on 4th June at around 9am. travelling speed is abot 70km/hr.. road condition is dry with low traffic..

 

i was travelling along ECP towards city before tanan merah country club exit, i crash into a tyre with rim in the 2nd lane slightly to the right.. there was a car in front of me and he swerve to the left just as he reach the tyre..

by the time i saw the tyre, i could only swerve to my left but couldn't avoid in time.. i got up and ran to the side, a fellow kind hearted motorist stopped to assist me.. a while later, a certis cisco road marshal came and removed the tyre..

 

ok.. my question now is, can i make a claim against LTA for their negligance of making the road safe? or i have to come up myself with the repair cost? my front rim broke...

anyway, TP did not penalise me for skidding..

Erm...hard to say man. Although I understand your situation we can't expect them to be there all the time when a wheel comes off a car.

 

We had a customer once who drove his car over a rock which he thought was a coconut. Obviously rock 1-0 car. Claimed his own insurance on that case.

 

I know it doesn't sound favorable to you but u might be better asking your own insurance?

Hope u r safe but since u said u got up and ran to ur side. But ur front tire damaged? Wa.

 

But sadly it is my opinion tat u do not ve a strong case or any case at all.

 

Becoz u were too close to e car in front which is y u didnt c e tire. if u had at least 1 car length between u and e car in front u would ve a fairly good chance to avoid.

traffic law states 1 car length for every 10km/hr (to protect themselves i suspect)

 

fact that you couldn't stop in time, traffic court will argue that you

were either tail-gating or speeding.

 

either way, you loose buddy..

 

hear-say or not (many moons ago,) i've heard of 1 owner claiming from

lta that his suspension got excessive wear cos of uneven roads!

 

last i heard, he won his case?

@captain. Quite weird if he wins. Becoz it would become a precedence for every tom **** harry to claim lta for suspension, tires, increased fuel consumption, brakes, etc.

 

Even bicycles also can claim if like tat. And also when we cross e road at traffic junction, my shoe bottom also wear. Can claim? ^^

 

meanwhile i will go search c if can find anything. Lol.

But e owner wanted to claim for damages, not wear and tear. An e adjuster trying to argue tat it is wear and tear so as not to pay up. Maybe u saw another case?

LTA can reply to you that a dispatch vehicle was already informed by someone else and is making their way to remove the obstruction. Nothing will come up of this claim.

I spotted a tyre on AYE(Tuas) 1st lane, on a bridge after the Sony's factory for more than 2 days. Not sure if it's removed yet.

Just to share with u. If u r at a hdb carpark. And tree branch fall hit u or vehicle. No claim becoz due to nature.

 

If u r in those open private carparks and similar thing happen. U can sue e management for lack of maintainence.

 

So for ur case, no claim becoz is public road. If in a private road (as in private carpark road or just with in a private premise) u can sue. ^^ different from claim.

Firstly talk to e management. Be confident about it so tat they noe tat u noe ur stuff. Of coz dun ve to be mad behavior although tat may work too.

 

Then if e above peaceful method dun work u can find ur MP first. Can also try ask ur insurance company if u bought any personal medical or accident insurance.

 

Basically it is a law tat within private premise, e management ve to take care of all this. They ve something called facilities management which includes e carpark (if any) an things like holes, safety hazard, dead falls (tree branches), etc.

 

It is part of e responsibilities of renting/owning e place. Stupid thing is public property dun ve this law.

 

Which is y u see/hear cases where pple wan to sue a private premise's management for things like slippery flr, not enough lights, etc which indirectly causes falls.

My friend skidded at marina south before. This was due to the debris and sand on the road left by the lorries from the nearby construction site. Long story short, he managed to claim against that construction company.

 

Unless you can find the owner of the tyre, don't think it is quite possible to claim against lta..

mostly likely owner of the tyre is a lorry or trailer. rear axles can accommodate more than 4 tyres!

 

please don't tell me they check even once a fortnight...

Ride M'cycle must be very careful, I forgot safety stopping distance but I believe its twice that of a car.

Cannot blame LTA unless U can prove tt they know and purposely ignore, otherwise maybe it happened 5min before U came n they cannot possibly have done anything about it.

 

When U bang into such a big object, alive is lucky already. M'cycle is not a car, better to be humble, the will live long.
