Today 11AM PIE. I was doing alot of nonsense riding, the TP said he wont pursue all just the speeding he will give it to me.

 

Do they normally write down all the details? because he just gave me a prosecution note to sign 144 @ 80 km road.

Hi guys some advice now would be nice.

 

1 Month ago. I got caught speeding 81 at a 60KM road. *6 Points.

 

Just today, I got clock @ 144 @ PIE 14KM at that stretch TP that stopped me told me it was only 80KM speed limit.

 

When tp stopped me he told me it is a 18 *points offence.

 

So 6+18 = 24. I have 24 points im currently on 2nd year of class2.

But accordinging to TP web site. +60 or more warrants a *24 Points.

 

I was rushing to the CGH hospital for severe stomach pain and issue. Have time sheet and documents to prove.

Anyways im prepared for the worse. Any kind souls out there can advice me roughly where i stand?

 

According to TP web site says First timer a suspension of 3 Months. I'm ok with that.. just not going through the 2B phrase again.

 

With my valid hospital time sheet and a lawyer? Issit possible to get off the hook?

At this point, i believe the only one that can save you now is ur MP. Can try since you got documentation and i believe you were trying to 'save' money by not getting a cab instead.

Not to think negatively, be prepared as the judge will counter your statement with one that we learn from Driving Centers. "Do not drive when you are not feeling well, sleepy, angry,...."...Something like dat. I lost my Basic Theory Book sorry if I got it wrong, feel free to correct the statement.

speeding fines and points docked are very very hard to fight... confirm your reason will fail... if you stomach ache, you could have gone to the nearest clinic or took a cab there. The fact that you are speeding and weaving in and out of traffic is clear evidence that you know what you are doing. Should have learnt your lesson from the first speeding fine and points docked. I got fined with 6 points before, appeal with MP letter, USELESS... only delay the inevitable...

 

On a more positive note, 24 points docked means u are left with 0... u still can ride with zero... good luck, please learn from this.

speeding fines and points docked are very very hard to fight... confirm your reason will fail... if you stomach ache, you could have gone to the nearest clinic or took a cab there. The fact that you are speeding and weaving in and out of traffic is clear evidence that you know what you are doing. Should have learnt your lesson from the first speeding fine and points docked. From how I understand the system, if you did not complete the 1 year cycle of clean sheet, any points gotten will be added to it plus the date for the expiry of the demerit points (of yours 22 points) will expires 1 year from your Nicoll Highway date.

 

As for court case, my only advice is for you to bring in lots of cash to pay the fines and be remorseful. You could try to appeal.

i just paid $500 for 12 pts and speeding exceeding 40km/h those who got 18 pts were fine on the same day as mine as well, from what i see, u can only suck thumb and pay if im not wrong is $800 plus 18 pts and pls dun try to give stupid reasons got 1 guy go and give reasons and try to appeal in the end judge gave him suspension of 3 months of all classes of licenses plus $800 fine

if you're the first biker after those incidents then be prepared to be made an example.

 

speeding and reckless driving / riding should be confined to your own property if its large enough, else don't ride at all.

 

with your previous conviction, admit guilt & move on, you are just a statistic.

 

if jail term imposed then a lawyer might be nice, judge sees your lawyer think you're 'loaded' then you should also pay a 'loaded fine'

 

else no need for a lawyer, admit guilt move on. license anyday also can get. no problem.

Do not go to MP, MP is useless at this point of time. Seriously take this advice. It would just waste your precious time.

+1 MP is indeed useless also fighting is not the right choice for you to do now.

I disagree with this. Cases i saw with my own eyes represented with lawyer reduces the fine and some got lighter sentenced. In other way, the lawyer will not fight the jurisdiction but rather mitigate for you to pledge for leniency and so your sympathetic story got spread out and file were given to the judge to read 3days before your judgement. My case was 2010 i was just prosecuted last month and i got to say they are not that heartless to make that just because of one bad rich china apple. 24points i suggest you get a lawyer just to mitigate. Before the judge throw the hammer down he/she would ask you, do you have anything to say and know that for your offense exceeding speed limit above 60km/hr the court can suspend you. Given you to be in that shoe, you would probably be so nervous in front of crowds waiting to get persecuted like you too. I know I've been there and i was doing the same offense as you.

 

To clear the confusion of points 24 points 12 points... here is what i got to say.

We don't have 24points.

We have 0 points.

Probation rider below one year can accumulate only 12 points of offenses. (P PLATE or just pass your other class of license)

Non-Probation rider can take up to 24 points (Once you hit this mark you will be suspended.)

Example of Suspension:

Beat red light twice. 12+12 = 24

Got caught speeding that carries 6 demerit points four times. 6+6+6+6= 24

Beat red light, got caught speeding 6points some later date and two illegal parking. 12+6+3+3=24

Correction to this confusion all of us 0 points demerit. Traffic police will give us the DEMERIT points and to what level we can take not how much we have.

 

Motorist with Suspension Record

 

Mr A served his suspension that ended on 15/11/2000. His previous 26 points are expunged but his suspension record still stands.

 

Because his previous suspension is still on record, Mr A will be liable for another suspension if he accumulates 12 or more demerit points within 12 months from the date his suspension was lifted on 15/11/2000. If he maintains a demerit-point free record for 24 months starting from 15/11/2000, his suspension record itself will be expunged on 15/11/2002.

 

On 1/9/2001, Mr A commits an 8-demerit point offense. The 12-month and 24-month qualifying period for demerit points and suspension records to be expunged respectively will then start from 1/9/2001. If he maintains a demerit point free record:

 

a) On 1/9/2002, his 8 demerit points will be expunged. However, his suspension record still stands and he cannot accumulate 12 or more demerit points within the next 12 months.

 

b) On 1/9/2003, his suspension record will be expunged. He will revert to having a clean driving record. This means that he can accumulate up to 23 demerit points within 24 months. His license is liable for suspension if he accumulates 24 or more demerit points within 24 months.

 

 

SPECIAL CASE SCENARIO

Meaning to say once you got your suspension you served. The day you collect back your LICENSE you won't be like people says 0 points. You will be on probation which you can only take up to 12 points and not more, what if you hit more again?

Suspension NO 2.

Repeat. Court, Fine, Suspend how long? Now you are looking 12 weeks beyond seriously but still it's below 1 year.

once you got your suspension you serve. The day you collect back you won't be like people says 0 points. You will be on probation which you can only take up to 12 points and not more, what if you hit more again?

Suspension NO 3.

Court, Fine, REVOKE.

In all what if you maintain a free record of 1 year from that DEMERIT points? You are now officially NON-PROBATION RIDER.

If you subsequently maintain a two year free record. Your suspension records will be erased. If you ever got caught again it will be your first suspension offense not second.

 

Well, i hoped i clear a lot of doubts and confusion here based on my experienced.

 

For now you are looking for 1st time suspension. Fine not exceeding $1000. Suspension for 4weeks, but judge can give you more some get 12weeks.
