self skidded accident...need advise

I was travelling from mandai rd toward upper thomson rd today @1840 just now...my accident happen just opposite the seletar reservoir...i suffer few bruises and my gf first suspect his hand fractured...so its a must for me to call the ambulance.

 

How it happen...if u all are famillar with the road there...there is a bend there...i was conering this bend when i saw this bus trying to u turn...i see it out of sudden due to the blindspot of the corner....i manage to brake...and control my bike...but the bus just stop there n blocking the road(one way)...maybe he was shocked to see me...i too was shock...this time i jam brake to avoid the bus and skidded....haiz...

 

there is one bike behind me who manage to stop safely...thanks for helping me...not that bus driver...he know i skidded because of him...but he heck care...when ask for his ic he did not want to give cause he said i did not bang him y should i give...and even said that im not scared cause i did not bang u....

 

haiz i really know my english sucks...but the tp just called me just now and say that its my fault cause i self skidded and did not hit the other party...haiz do i have a case to fight or issit lan lan already my fault...now i also donno to inform my insurance or not...

the bus driver of course never admit fault. so going by evidence u will be charged fine 250 dollars plus 6 or 4 demerit points.if got photo can prove that he did illegal u turn.anyway glad u are safe and hope your girl recovers soon.

Bikers like us are always at a disadvantage.....

 

Bike damage can be repaired. Check with your motorcycle shop about the insurance claim, they might help you.(The shop you bought the insurance from....)

 

Luckily you are not seriously injured, be thankful for that.....

haiz that the sian part...already accident...then the potential of demerits point and fine also in my mind...i got witness for the accident...he also know what and how it happened...and he is also willing to be my witness...but seem like he is not really needed now since like the tp also said...i never bang the bus...the tp too says that the bus driver have the right of way to turn right there....but remembering the incident..he wasnt even look like he is turning right...he was covering the one lane horizantly...in that he endangering the road user and his bochap attitude really make me heart pain and angry...keep on saying to me u never bang me im not scared...when i never even talk to him at the first place....if was my witness who do the talking...

 

Insurance part...i yet to inform my insurance...im not really sure to involve with my insurance...cause if tp insist it selfskidded...then i dont think i will be on the high side to claim...i might end up suffer longterm for my insurance...as for my bike i really donno the condition...i dont look give a damn at it when it happened...

 

anyone involve in a self skidded case b4...or just anyone opinion...shall i just face the lan lan suck thumb case...or i have a case to argue and fight...

on 1 aug 07.. i was involved in accident.. was exitin da expressway.. i saw da car in front of me.. frm far already.. so i close throttle n glide.. den as i was nearer to da car.. i slow dwn by applyin a bit of brakes.. suddenly.. der was a bicycle on da right side of da car.. on da normal lane dat is as we`re emergin frm da expressway.. da car in front of me jam brake n i jam mine harder.. i avoided da car as a result but i was thrown off my bike.. i did not hit dat car.. but da car n cyclist move off happily.. i broke my arm n was warded.. tp eventually contacted me.. die2 say my fault.. eventhough i had witness.. my io was very persistent dat it was my fault cos i was followin da car too closely.. i doubt she even drive or ride.. i was too lazy to argue.. cos she say da sooner i pay my fine.. da sooner i can redeem back my 6pts.. so wat options m i left wif but to settle it..

its a legal right turn...but u turn i tink also can...but then again...u got to question the vehicle positioning of the u turn...if he were to turn normally it will not block the road..but i belive he was trying to make a 3 point turn...and he block the one way road and the bustop tooo...Yeah from what i know the tp call me and said that he want to make a right turn in to the cp...cannot be what... i also drive...and i know with that positioning he want to uturn...

To my understanding, if traffic offence (eg:. careless driving/riding w accident $200 6 pts.)

took place on 1st Aug 2007

 

received tp's love letter on 1st Sept 2007

 

paid up on 5th Sept 2007

 

The demerit points should be as of the date of offence... not date of payment.. Of cos i dun recommended dragging for too long, u might end up with a warrant of arrest against u... I am not sure if its the same for all/appeal cases.. if in doubt, pls go to http://www.spf.gov.sg/epc/index.htm to check if u got any outstanding traffic offences(excluding hdb/ura...etc)..

yeah men i got 6point and fine $200.The io keep saying he nows how i feel lah and he says he is also a rider for 8 yrs.he just told me to be careful.and by law im wrong cause im not able to brake in time or control my bike...which mean careless riding....as for the bus though he is dangering me he could not do anything as he have the right of ways to turn right...i still not happy with this ...as far as im concern if he were to turn right his vehicle will not be parallel to the road.He must have been trying to u turn..and it is wrong wat to 3 point turn....nvm lah rest my case here...no point me whining here n there when i kena already...

meanwhile engage a lawyer to fight the case.

 

the thing with POLICE is they always tried to shrink responsibility & save their own trouble, in order to conclude the case, unless they themselves are involve in THE accident or they themselves is the witness.

 

i also involve in a self-skid incident more den a year before, never gana fine or deduct dermit points.

 

story goes,

 

was travelling at the third lane, got a old b@st@rd SDX 5397Z, cut my lane abruptly without signal, den comes to a complete stop in front of me (think to buy 4D, cos got singapore pool there) ,(he stop on a third lane, FYI, fourth lane is a parking lane lot but totally FULL)

so i jammed brakes, and self skid without hitting his damn car.

 

he got out. check his damn car for scratches, den tried to move off. i scream at him, and he agrue that 1) he didnt see me at all cos 2) i was driving too fast (i was riding a vespa btw)

 

wanted his particular & license, he refuse to give me, insist its my fault. later he offer me $50 which i rejected. I say i wanted to claim his insurrance, and call POLICE etc. He ask me to go ahead since its not his fault.

 

Police arrived, take particular, den ask whether i wan ambulance, den ask us to go make police report.

 

after all the Hola, got summon to go TP for interview. say no witness, and the driver insisit its my fault, cannot do anything.

 

was super pissed. ask the officer, whether does it make my claim stronger if i were to hit into him? Told her i wasnt interested in the claim, the least they can do is to summon him for parking on the 3rd lane wah.

 

went home feeling sore,and lotsa injustice. I should have bang on to him and damaged his damn car. To come to think about it, i suffer injury, bike damaged, yet its my fault??? The stupid driver, no injury, no damage to his damn car and happily went off.

 

the scale is not balanced here. against all odds, some say i'm crazy, some say its not worth the money, i engage a lawyer to fight the case. from the lawyers extract of the driver's police statement, i realise some interesting info.

 

1) he was a public servant

2) he say he was driving on the second lane, and from his REAR mirror he saw me self-skid, so even though there wer lotsa cars parking illegally on the 3rd land, he managed to cut into the 3rd lane, to STOP TO HELP me? (instead i accuse him of his fault) and to be able to see me in the rear mirror is unless i'm very far from him or directly behind him. Obviously he didnt check blindspot wah. He was more concern with his god damn car, rather den to stop to help me.

 

 

And I seriously do not believe singaporean would stop in the middle of a busy street to help u, esp when its not his problem. nobody help me when i was there. not even predestrian (all uncle and auntie, who are more keen on 4D, my license plate come out second, i think, sign, didnt buy). For me, i will stop to help, ONLY if 1) its an quiet street, nobody to help the poor guy 2) if its safe for me to stop, i.e, on the highway.

 

Anyway, it had been one year le, the verdict from the judge?

both side insist on their side of the story, so the judge conclude the case as 50/50.

 

my claims = $8k plus

his claims = 0

 

after 50/50, i should get $4k, lawyer told me they bargain til $2.9k. I told my lawyer, i'm not really keen on the money, i just wan the guy to feel the pinch, or rot in hell.

 

For u my friend,

 

your case is stronger, cos u have a witness. ( i got no witness, no photo, nuthing)(the other party have his wife and he took photo)

 

so get a lawyer and go win the case. I have clients who drive (car) and are involve in road accident, she told me that there are many time when its not her fault, but she still lost the case, because the judge conclude that bikers have the higher benefit of doubts cos they are less covered and are less visible to the car drivers (more blind spot).

 

So after u won the case, write a letter to TP, and complain the way they mishandle the case. Have money, will travel. Dun let the TP hold u down. They are only servant of the law, they aint the law yet.

if another guys need advices, i have the guy who can help u. He is experienced as he used to work in AXA claims department. He do not charge for queries. He charged only if you get him to handle your case. I got a few clients under his care and so far so good.
