Hi all, I need advice on some things.

 

I got into an accident 2 months ago and due to that I had loss of memory of what happened. My friend who happened to notice my bike, stopped by and talked to the TP and 3 teenagers. I was already brought to the hospital in an ambulance. Later, what I found out from my friend was that the 3 kids were jaywalking across a 2-lane carriageway. I swerved and avoided those kids but unfortunately crashed somewhere. Another friend of mine stopped by the accident spot one day and noticed that there were fresh damages on the bark of one of the trees. Most probably I had crashed onto that.

 

99% of the injuries I attained were internal injuries. I had pan-facial fractures, left pneumothorax(collapsed lung) and some other internal injuries. The thing is I had no abrasion or swelling at all on other parts of my body except for my face. Upon my discharge from the hospital, I saw on my hospital records that I self-skidded, landed on the left side of body and dragged under motorcycle about 10metres. I was puzzled because my injuries do not tally with the way it was described in the records and this may affect the investigations.

 

From what I've been told, pedestrians are always right, no matter what. In my case, this is a disadvantage for me because I was the one who got injured due to their negligence. From the last I remembered, I wasn't speeding as I wanted to turn right at the front junction.

 

How do I go about in my case such as the incorrect records? Am I at a lose situation? How do I, if possible, claim from the kids' parents due to my excessive hospital bills? Any other advices will be appreciated. Thanks.

 

 

The good news is that pedestrians is NOT Always Right in the eyes of LAW!!!

Like many of you I was bias towards our traffic enforcer.....but Sorry to say,

they are very objective especially towards vehicle-to-pedestrian accident.

 

Some key factors that influence the investigation outcomes was, the speed,

location, possible blind spot, pedestrian behavior/jaywalking, past history

of accident at the location, witness, Idac report, police report, riding experience,

weather condition, traffic flow...etc.

 

Should you suffer any personal/vehicle damage...you can make claim against

other road user (jaywalker)!!!

My question is:

  1. Do i need to get the bike towed to IDAC even tho i'm not claiming from my own insurance (NTUC)? Absolute Yes
  2. Can i send my bike to any bike shops for repair? Or MUST i go back to the one its hire-purchased under (ie. still under installment)? Yes
  3. Do i have to pay for the repairs 1st (and wait till the dickhead's insurance company pays me back)? Yes
  4. When the dickhead's insurance company pays, who will they be paying to? Owner, hire-purchased company OR repairing shop? Hmmm...i think you hit is rear...he might claim against you....

Guys, I got into an accident 2 months ago and it's a hit and run case.. How do I go about making claims? Able to claim if the driver cannot be found? How do I go about repairing the bike if the driver is not found yet? Any kind soul can enlighten me?

Hit and run case can't be claimed.. But u can try Motor Insurer's Bureau of Singapore (MIB) but they only compensate death or bodily injuries and not property damages.. U will need to make a police report and depending on ur policy if comprehensive u can claim urself if other policy u will need to pay for the repairs.. U will need to do an accident report with ur insurance.. Call ur insurance for advise.. If its NTUC income u can call 6789 5000..

 

Let me remind u tat unless u have vehicle number or driver is caught, if not its all under Own Damage meaning claim urself or pay urself.. Sad to say there's nothing anyone can do unless u managed to find a witness who saw the vehicle number..

Hi for enquires, my friend got involved in an accident in JB with a singaporean bike.

He say he was negotiating a bend, when he went out of lane, and that is where he was knocked by another bike.

 

Funny thing is, his bike didnt have any scratches except from the side where his bike drop, but the vehicle that hit him was damaged pretty badly.

signal light, mirror, fairing crack etc. We told him he could fight for the case and get insurance to pay both parties 50/50, but he felt he was at fault for going out of lane, hencehe has agreed to let the other party claim against him fully. Claim proceedings has been submitted.

 

I would to know, in the eye of the law, who is at fault, and how should the compensation be like?

Would insurance reject the claim as it happened overseas? And the claim was reported after like 2-4 days later?

Would my friend need to fork out any sum from his own pocket?

Right now, i would like to make a claim from that person for my injuries and my full bike repairs. Will IDAC entertain me to do an assessment 3 months later? Thanks

Firstly, always always remember this, private settlement or not, make an IDAC report within 24 hours to cover your own ass. You will never know whats the other party is thinking. They might agreed to a private settlement and when they got home, they get other advises from friends or whosoever. They changed their mind and you are still in the dark. The only reason you does not have to make a report within 24 hours is when you are in hospital unable to move.

 

But since you said you had made insurance report, isnt it the same as IDAC report?

 

The practice now requires the 3rd party insurers to make a pre-repair inspection (layman term - take photo of damage before you do any repairs). But the fact that you had touched on the repairs will make you on the losing end. You may wish to reconsider your alternatives.

 

1. to let go of the repair costs and just proceed with the injury claim

2. try your luck to include your repair costs into your injury claim.

Just met with an accident last weekend, was going straight along Geyland Road when this Comfort cab filter all the way from the left to the right trying to do a right turn into Geylang Lor 9, I applied brakes and swerve to the right along with his vehicle to avoid him but when he finally makes the right turn his front bumper hit my rear wheel and I skidded for awhile before I fell on the left and my bike slide all the way to the curb.

 

Taxi driver came out of the cab and saw my bike's damage and say he cannot afford to settle it privately cause my bike is too expensive (ducati monster 821), and will do claims. Ambulance came and patched me up then TP came right after saying this is a minor or something. I declined to be sent to the hospital as I am able to walk and sustained no head injuries. Taxi driver passed me 100bucks before he left he say is to let me see doctor.

 

My bike is severely damaged but I escaped with some bruises and abrasions. Bike has to be at the workshop for weeks or maybe months for the parts to be shipped over for repair.

 

My main concern is if the cab driver would twist his story because I don't have any evidence saying that he is at fault, or video/photo evidence that he is at fault. There are some damage at the front of his cab as he hit me from the front, but what if he sent it for repair and I lost that leverage as well to do any claims against him. It was late at night and there was no witness.

 

Did everything that need to be done, police report, insurance report, have some photos but I don't think it's sufficient.

I am trying my luck if I get any response from here.

 

I am a new rider. 22 year old under P-plate. I just bought a 2nd hand Yamaha Spark 135 (Clutchless) FBE plate on one of the bike shops in Eunos area 2 days ago(28/10/16).

I have registered my GF as a subrider as well.

 

Yesterday my GF was riding the bike on PIE just after Exit 9 to Jalan Eunos, when making a right turn, she skidded. It was raining heavily. She flew off the bike and sustained fracture bones near Spine/Pelvis area. Thank God no operation needed. She mentioned that 4 riders and 1 driver (Kudos to them) stopped and helped. The car driver helped to send her to her workplace at Eunos area as per her request. NO TP CAME into the scene and her colleague helped to push the bike out of the scene quickly. No other parties were involved also.

 

Bike Damages:

- gear shifter/lever bent, seems really very tight and stuck. Can't change gears no matter how much force I put on it(even if I stand on it)

- gear stuck on 1st gear. Engine is okay on idle but when i rev the throttle, engine dies. is this because the gear stuck or what?

- front fork misaligned(front wheel and handle bar out of sync)

- left fairing scratches

- left mirror misaligned (stuck and can't bring back to original position)

 

I have some concerns/questions:

- I have not contacted the shop yet as the day of accident was a Public Holiday and today is Sunday. Should I call the shop and claim that I had the accident on my own instead of telling them that the subrider was the one involved? (I have issues and worries about insurance not yet officially goes through the system for subrider)

- For the bike repair should I or can I claim the damages repair to the insurance company without getting the police involved? Or should I just pay the repair cost without insurance agency coming in to the picture

- Will the police know about this and give me or the subrider demerit pts + fine?

- Can my bike still be rescued/saved? Around how much is the damage if I decide to pay it myself?

 

Any help will be greatly appreciated. Thanks so much riders!
