Hi Guys,

 

I got the personal claim for damage Yamaha RXZ135 owner.

 

I was walk thru fulled bike park and accidently touch the someone's bike.

 

The bike has side slip and hit the ground (got 3 cm dent on Fuel tank).

 

I looking for the bike owner for 30 mins but did appear, so I left my information with my apologize and the owner call me and asked me 200 SGD for replace the tank.

 

I refuse to pay cash, and it happened at Car park, ask him to check insurance company wether they covered this case (company say, it's not a contact within bikes, must go with personal claim).

 

Finally he brought the bill that he had repaired his bike.

 

Can you believe 1800 SGD!! And regal acting fee is 1500 SGD top over the mount.

 

Total 3,300 SGD , Should I pay or not??

hi, if you are sincere about replacing his damaged tank, you could call Hong Leong Yamaha and enquire about the price of his tank. pay him the correct cost of the tank and tell him to F off. if you are unsure about his bike make, you could use the LTA bike transfer function, key in his number plate and you will have model and make immediately.

if he asked you for $200 basically tats the cost of the whole cover set. a new paint work would cost more then tat price he is asking for. if $1800 maybe he charge you for overhauling his bike becos who knows when you drop his bike something else damage his engine. should have paid 200 bucks instead of refusing.

$1800 is enough to buy some major engine parts like the crank casing and perhaps the top block, i don't think a stationary drop will result is such parts being damaged, if he just stated the tank was damaged, make a police report to cover your own a55 and just pay him the cost of the tank. the police will not intervene as there are no eyewitnesses and lack of evidence. if you say you didn't do it, they can't accuse you either.

guy thanks for your opinions, the bike only damaged tank!! (I checked for 30mins) it wasnit hit ground hardly (i was try to hold). He's asking repaire 8 month after that happened. who know He slip again last 8 months.

now that this has involved the other party getting lawyer, u should engage your own lawyer to protect your interests. A lawyer will be better able to advise you on the next step to take.

P-plate should be an attitude to safety and riding. There's always more to learn.

hmm, if he asked for repair after 8 months after repair then its ridiculous his just trying to get a free lunch from the scratch tank. engage a lawyer is the best thing to do. that bugger thinks his RXZ is some big bike to claim a huge amount from you.

You mean you gave him your apology and contact details but then when he called you to pay $200 for the tank you refused and asked him to go thru insurer instead? I believe you dented his tank and $200 is acceptable for a new tank plus spray job. If you were sincere you would have done your homework,paid up and the matter would have been settled. And you mentioned 8 months. So all this while you were happily keeping quiet hoping that you don't have to pay a single cent for you mistake? I'm sorry but this whole thing gives me a feeling that it isn't just the bike owner that wants a free lunch.

Yup.. i seen this type of cases previous so no choice if u rejected the $200 compensation so he just goto do something which end up in this big amount to claim from u and most important, he did it in a legal way i suspose...

To be fair to TS, I think he was rather brave and responsible to have left a note to take responsibility for the bike drop he caused. Own up, how many of us would have acted in the same way, or behaved otherwise when it happened before?

 

TS was responsible, but he is probably also a thrifty person who wanted to save money in bad times, or bargained out of habit. That was in conflict with his desire to resolve the matter responsibly.

 

No one would think that things would play out this way. But we're all tagging along this thread to see the outcome because it could happen to us, no? I still think its better to get a lawyer. Keeping my eyes peeled on this thread. Wish u luck TS.

I agree with this...:thumb: for TS

but 3.3K is too much for a drop....and that is after 8mths...

 

I think TS can call the dealer and find out the cost of repairing the tank with repainting...write a cheque to the owner and if he's not happy with the amt...he can go ahead with whatever he wants with his lawyer...He needs to prove that any other damage is caused by the drop.
