Hi guys...need advice,help and input from u all...

 

 

Recently had an accident due to a foreign vehicle (Malaysia Car). On the scene the TP told me that it will be my win case as the car obstruct my right of ways and cause me to skidded...

 

Problem....

 

The car is term as FOREIGN Vehicle...hence my insurer wont be handling it...required a bikeshop that can settle the matters...

Bikeshop told me that its gonna hard for me to claim from a Malaysian car...eventhough its my win case...it cannot guarantee that i can claim from the driver insurance....

 

but nevertheless he help arrange for me a lawyer for this matter...and the lawyer seems to be talking the same thing like my mech says...it can be a painful as they cant gurantee i can claim...so she did not wants to proceed the case for me...but she will try to find another lawyer that is familiar with handling foreign vehicle...

 

In the mean time...she also ask me to source around too....

Anyone ever experience similar case like me?

any law firm that u all knows that familiar with this matter...

Even lawyer also say the same thing. I think if the repair is not much, might as well repair it yourselves and get over it. I also have heard alot people saying hard to claim against foreign vehicle. By getting a laywer, the cost may be amplified alot. And who will bear the cost?

don't bother, when it concern foreign vehicles, its much more complicated.

 

they can chase and stuff but if the other side also act blur, you also cannot do anything..

 

if damage is minimal, repair yourself and curse the fellow.

 

or if you like, go get some PI to track the fellow down, then hire people go vandalise his car! yeah!

i had a similiar incident

Foreigner driving rental sg car and accident w me.

 

first Lawyer said same thing cos driver not in sg so difficult to claim.

 

So impt thing is to check with TP if other vehicle has insurance covering him/ her in sg and claim against their insurance co (even from malaysia)

 

hope this helps.

me also going to different lawyers checking things out.

 

i will send u name of recommended lawyer later

i think...

 

foreign vehicles' insurances got cover them when they are in foreign country? i think 99% no...

it applies for our insurance as well... only a small portion of the insurance companies do cover us when in Malaysia and also up to 50KM from the border of Malaysia into Thailand... try checking that out in your insurance clauses...

hence in SG when they are in here and got into accident, they can't claim us nor we can claim them...

things get kinda messy & difficult when it comes to lawyers of each land i suppose... imagine a SG & SG vehicle accident claim (i knew) can take up to 4 years if 1 party tries to deny, things will definately get longer if lawyers from SG & MY is fighting...

i also know of, 2 SG vehicles gets into accident in MY, on some reason, one is also can't claim from another lo...

I thought if foreigner driving a SG rental car, U claim against the rental company? Then it is up to the rental company to go after the rentee..

No help against a lawyer...

Ive already repaired my bike anyway...but before that i did email the driver insurance(Alliance)

 

today got a email from Alliance Singapore...seems they are helping me in this case, The Malaysian side have give detail of the drivers and stated that insurance will be covered during that accident.

This thread has given me a lot of info ... thanks as usual to all bikers who have the spirit of sharing ...

 

One malaysian biker collided into my rear .. causing minor damage but I think claiming against his insurance is almost impossible ... there should be a better way ...

 

Any other bro has similar experiences?? Can share how you managed to deal with the claim?

We can only claim against out insurance if you get 1st party or comprehensive ... but its unfair when its not your fault at all, to claim against your own insurance rite?

I've had Frends who had such encounter Bro. Sad 2 say the Malaysian Lawyer will no co-operate as much hence it will b a tedious Call. U muz also take into consideration Ur Lawyer Fee, the Letters the Send Overseas etc, all is $$$ Bro. If U suay the Case stale then U muz b the one 2 settle all Ur Lawyer Fee & Repair urself Bro. Nt worth it at all. IMO juz settle the Repair urself & Suck Thumb loh.

It wld b Best if U had ask some $$$ fr the Idiot at the Scene itself before he left. Save U the Trouble & U still will get some then nothing at all Bro...

Thanks for all the advice bros. I will still try. And I am doing so coz it is not right that someone can knock you, cause damage n injury and get away with nothing.

Somebody should really do something about the law regarding accidents with foreign vehicles. There are so many of them msian vehicles in Singapore. Once, I got knocked down by a msian van but luckily the uncle paid me everything in cash.

My point exactly ... I wonder what are our legal avenues? Pte suit? Sounds more and more difficult ...

Like most advices here, the best thing to do in your case would be just settle everything yourself. It is really not worth it to engage a lawyer's help. Even if you manage to get him to pay, it will most likely take years before it will happen. Just my two cents worth of advice tho.
