yo, i can be quite sure. if there is no contact, idac will not consider it as accident and they dun even bother to take in your case. it happened to me recently and i just LL let it go. sigh!

A bit hard ah.. It will be ur words against the driver.. But if u got the two fellas there who can vow for U.. Its ok.. Then when reporting make sure u play out the whole event in your head.. Every detail try to remember.. Ur statement with idac must tally abit with what u tell the IO..

 

U got hit the taxi..?? If no then dun worry much about getting fine or points.. But keep in mind the speed ur going at.. The IO will confirm ask ur speed, so u might just get fine for speeding and carelessness if U dunno how to answer properly..

 

Prepare a sketch also of the event, so when the IO ask for it u already have it.. If u wanna do the sketch there and then, by the time ur mind will be vague..

juz saw a black super4 accident with front of SBS bus at the junction of NUS / Fong Seng near the kaki bukit bus interchange. indian rider looks ok still standing up at the traffic light but the bike should be in bad shape as the front bumper of bus is heavily dented.

i kena this 2 mths back too... lorry cut into my lane and brake.. i fly... TP came as well as ambulance, they say if i make a police report then i will be charge with self skid. because the lorry didnt bang me they consider my case as self skid...

wah this is BS sia.... lorry cut into ur lane, is diff matter wor. For iqiem case maybe, he did not have a safe following distance...

 

but if lorry cut lane... how to do anything but siam?

I got something similar to your case but it is slight worst than your. A truck cut into my lane sharply and the next moment he JAMMED his brake (probably the front car trying to stop due to red light) and you can hear the sequeeze sound from the truck tyres . I nearly lock my front wheel cos i pressed the front brake too much but foruntately i managed to balance my bike with my foot and thus avoid the skid .

 

Assume if my bike skidded but never bang into into the truck . Do the TP still give 6 point to me for this so call self skid. I think for my case , I have a vaild excuss to claim against the truck driver cos this driver is driving recklessly and endanger other road users.

 

 

Any way back to this case , if you have follow the safe distance rule ( 10meter for every 10km/hr ) then you should be able to avoid the accident . Unfortunately i know no one follow this rule and that including me .

 

Thou u saw the reverse light from the taxi but that does not mean anything , unless you really saw the taxi reserve backward toward your direction .

 

 

Btw , are u refering to the divider as is the middle of the lanes. I have not seen a filter with 3 lanes .

i would agree with most here who think it's tough to claim. the driver can claim u followed closely. i had an accident a couple of yrs bk whereby a car cut into my lane, i couldnt stop in time in bang into his right rear before losing control to hit another volvo which actually cushioned the impact. that's why i'm still riding today. but in my case, i knw i was going a bit fast and so partly my fault, the driver is also at fault. i did not file a claim cos i knw it's hard. i got 6 pts deducted and a fine of $200. but the drivers that tried to claim against me did not succeed. :cheeky:

 

in your case, there was no contact and the car infront wasnt even damaged. so chance abit low.

Ya lor... its like split second i see one lorry infront of me and i brake.. my both wheels lock and then the next moment i tink i fell asleep and someone woke me up... then the lorry drove off... TP never say anything but said to me if i make a police report i will probably be charged lor. bike is like... gonecase. So i went to the police post instead and relate this thing to a CPL, immediately he say "oh so did the lorry hit u?" i say no... and he say that means u lose control ma self skid rite? damn pissed... So i say, i dont jam brakes then go kan the lorry meh?! Then that guy say in an even louder voice "i also ride bike one tink i dunno? u wan make police report can lor go ahead lor but u will get charge for self skid in my opinion"... So lan lan... Take it as im lucky la didnt get killed in the rush hour traffic..

Erm... i tink its like a heng suay 50-50 kind of thing... The police simple tell me, nobody hit u and u fell means u couldnt control ur bike, that means u self skid. Sounds bullshit la buthen... i tink is case to case one lor. Sometimes SG laws also abit knn one la.

just went to give statement to the TP...and they are damn slow in processing...the taxi driver never go and give his statement and they never even pester him...

anyway...i handed the papers to retreieve the bike from TP custody to my bike shop...is there anything i need to do with the insurance company cause my bike shop say he will settle the insurance thingy for me...

what's the safe following distance for a stationary vehicle.. :sian:

 

and of course a taxi would have reverse lights. why not?

 

assuming iqiem has been truthful all along. that he had time to see the taxi, slow down,

horn and then try to avoid when the taxi reversed, and not even hit the taxi, iqiem

would have been at quite a substantial distance behind. common sense and physics

would tell you that.

 

and it is not just iqiem vs. the taxi driver. it's iqiem + the 2 malay guys vs. the taxi

driver. so long as the 3 of them give the same story during the investigation, igiem

should have nothing much to worry about.

 

the best and most neutral person would've been the taxi passenger. that person

would know why the driver stopped and if there was really a sports car. the passenger

would also be able to confirm if the driver reversed, assuming of course the person

wasn't sleeping throughout, and that the person is available and willing to be a

witness in the case.

 

however, iqiem's inexperience and not the driver's 'experience', may be the real

reason behind the skid and accident. although a sweeping statement, it's much safer

to presume that a taxi will stop whenever and wherever it wants to. always be

prepared to avoid when you see one.

 

that much having been said, good luck to igiem. hope you recover in time not to

screw up the coming exams, heh..

hmm well, but the TP said the passenger has the right to not stay at the scene of the accident and not obliged to be the witness because she was not injured in the whole process. so it depends on what the TP has to say..

he just being lazy lah. but dont tekan him. he has the power of your case in his hands. if the tp assess that you are at fault and u get 6 pts demerit, then this accident is your fault! If he assess that the taxi is at fault then u can proceed to claim damages against the taxi (long tedious legal process especially since most taxis are insured by NTUC income and they will fight tooth and nail over even 1 cent of claims). Do get the helpful malay guys to call him and say they willing to be witness that the taxi got stop.

 

From the looks of things if u are in the filter lane u are supposed to be riding slowly anyway ( we all know that isn't the case in reality ) so it all depends on the TP assessment.

For your insurance which insurance are u on? Are u on comprehensive or 3rd party/3rd party fire and theft?

 

is the shop confident of u winning the case vs the taxi and as such doing the repairs without claiming $$$ from you first in the anticipation of the taxi's insurance company paying out?

erm mine is ntuc 3rd party with fire and theft...

he say he will help me settle the insurance side only... didnt say much..say will tell me more when he gets my bike out of the TP compound...

i agree with you that cannot be we use our body to cusion the impact mah. Hw ah?? Aniway to protect the interest of us bikers? Really want us to bang into them then is their fault meh? They might get jailed but we will already be in heaven (or hell) le.....:mad:

jus a word of caution to u on letting the bike shop claim your insurance for u. certain bike shops have been known to do this cos they will overclaim the insurance by claiming excessive damages than what u got on your bike to sue the other party. if it goes well, u will not be needed to pay, but if they did not win, u are liable to pay for all charges including the lawyer fees which can amount to a few k which is way above a simple repair. my advice to u is to check before u sign anything.

Hey guys,

 

Learnt alot over here.. Self-skidded while avoiding consider bikers' fault. I tink most of the drivers duno leh, n they happily cut into our lane thinking we can siam.

 

Like tat how ah? Any ways to increase their awareness about it. Else we always at losing end leh. Losing our lives, limbs, money and bike, time, inconveniences, and losing even in term of JUSTICE.. Haiz... V.sad.

 

As for iqiem, I tink ur case very dependant on whether the witnesses saw the cab reverse. If they saw it, u will have higher chance. Too bad, u didnt c the passenger else can ask him/she b witness. He/She will noe whether the cab reverse on a highway..
