Details of the Accident involving FBBXXXXE (Motorcycle) and SGBXXXXJ (Car) on XX Mar 07 @ 6.00pm along PIE

 

On XX Mar 07 @ 6.00pm, I was riding on the rightmost lane (Lane 1) along PIE towards Jurong @ XXKM Road Mark at about 60km/h due to heavy traffic. The condition of the road was dry with clear weather. As I was riding at the center of the lane 1, I heard a car horning repeatedly behind my motorcycle for quite some time. The next moment, the car driver had tried to overtake my motorcycle dangerously without due care within the same lane that I was travelling in front of his car, resulting in a collision on my motorcycle. Thereafter, I suffered severe bruises on all limbs and the metatarsal trauma fractures at the 2nd, 3rd and 4th toes of my right foot. As I was lying on the road with painful sustained injuries, the car driver stopped his car at the rightmost lane (Lane 1) in front of the accident scene and approached me without rendering any assistance and showing no remorse of causing hurt to my injuries. He was angry and scolded me repeatedly with unreasonable wrongful allegations, “You are road hogging and motorcycle should not be in Lane 1”.

 

Fortunately, 2 drivers at the accident scene came to my aid and help me to the leftmost road shoulder. The car driver shifted his car from the accident scene from the rightmost lane (lane 1) to the leftmost road shoulder. And again, he approached me without rendering any assistance and showing no remorse of causing hurt to my injuries. He was angry and scolded me repeatedly again with unreasonable wrongful allegations, even in the presence of a passing Auxillary Police Officer, “You are road hogging and motorcycle should not be in Lane 1”. I asked the car driver,”Why did you do such a thing to me ?”. One of the driver that assisted me to the road shoulder argued with the car driver for being a Road Bully and behaving so fierce for causing the said accident and also said that, “We saw what you did to the rider from behind !”.

 

During that time, I had called 999 for Traffic Police assistance. One of the driver had offered to be my witness of the said accident. One of the other drivers told the car driver to report to IDAC centre on the said accident and told me not to wait for the ambulance as I had a witness to justify my case against the car driver and later offered to send me to the Singapore General Hospital.

 

TP had completed their investigation which shows that the said car driver had committed an offence of Inconsiderate Driving under Section 65(b) of the Road Traffic Act, which resulted the collision.

 

Action has been taken against the car driver and he paid the composition fine of $200.00 with 9 demerit points.

 

As such, I had engaged a law firm to file a civil legal suit against the car driver on the following charges :

 

1) Inconsiderate driving without due care, attention and reasonable consideration for the other road user using the road.

 

2) Failing to render help and assistance to the injured victim.

 

3) Show no remorse of causing the accident.

 

4) Accusing wrongful allegations on the victim.

 

5) Removing his car from the accident scene.

 

Currently, the fractures of my right foot had recovered to about 80% and was able to walk with my swollen right foot with the help of crutches.

 

So, with all the pain and sufferings over my sustained injuries, I'm suing him for $50,000 on compensations and claims.

 

Hopefully, the court will imprison him upto to 6 months in prison and fine upto $1000 or both and also revoke his license and off the road for many years.

hah.. that really serious if he's charged with attempted murder.

 

But i think is impossible.. the maximum the driver will get is

INTENTION to cause grievous hurt to the driver which is heavier than

causing grievous hurt.

Considering that you have only 2 posts in SBF you sure know what to do in this case.

 

If what you had described is what actually happened in the accident , then yes go ahead and sue the FXXKER and make sure you have all your bases covered.

 

Although the ruling by the TP can be used in the suit later it can also be argue (aka the Fxxker's counsel- which is what his vehicle insurance counsel would do anyway )during the time of the suit, that the amount of fault on his part is not what you deemed it as.

 

So try to get some witness ( they should be independ witness ), evidence at road scene, damage to vehicle and bodily injuries and last but not least the firm believe to put this bastxxd driver to complete misery.

 

The civil court would not imprison him as this is all a matter of compensation ( even if he defaults later on judgement against him all you can do is file for a order to enforce it and proceed to recover what are the monetary compensation owed to you).

 

Bottomline is , I fully agree with you that the TP should have removed this particular driver from the roads ( they have a immediate 24 points for reckless driving charge) but apparently sometimes our courts sees otherwise.

 

Hope you recover soon and may there be less of such drivers on our roads.

You should appeal to the police to increase it to dangerous driving, as he deliberately crashed into you.

$50k seemed rather high. Repair say $2k, hospitalization say $5k, the rest is loss of income for 3-6 months, got so high meh?

You bet it will be in this region. A recent case was concluded when a female pillon rider sued both the driver of a taxi and the rider who pillon her when the door swung by a passenger had knocked onto her leg.

 

The amount of compensation was in the above $20K range.

 

So you be my guest to figure what would be the jusified amount in this case if you were the judge?

 

Nah, I will settle for $100K and when the fxxker's lawyer want to bargain then reduce to $80K!

Need to claim higher amount, $50000, as the 3rd Party Insurance may bargain down to $30000 which is not really a lot to cover my pain, suffering and hatred on the Inhuman FXXKing driver.

This Inhuman FXXKing car driver should be punished under dangerous driving.

 

Will bring out to my laywer on these matter for further advice.

IMO, the trauma dealt to the rider was nothing money can compensate. And... Yes, according to my experience I think you can claim that much. Hope you can share his car no. so we can look out for this joker? Really feel like giving him a piece of my mind. Arse hole.

Problem lies in this reckless car driver

 

1) Disregard safety for 2-wheel vehicle (rider with zero protection)

 

2) Drive without due care for other road user, especially motorcycle with P-Plate

 

3) Have a mindset that motorcycle should travel on split lane (between 2 lanes)

 

4) Have all right of way on the road (King of the road)

 

5) Hate motorcycle occupying the entire lane and blocking his way

 

6) Impatience, selfish and hot temper

 

7) Insurance will paid and settle for his misdeed and mistake

 

8) Prejudice and discrimination against 2-wheel vehicle (motorcycle)

lol... LTA should remove the signboards "motorcycle should not travel at lane 1" to avoid this confusion. i have been tailgated many times while travelling in lane one. and i travel 90 - 95km/h. d*amn the drivers..
