peeps i got a problem on my hands, i bought my bike last year from a shop in ubi ( after realising the i had been scamed in my lta fees).

 

About in november i went back to renew my road tax but the shop say they will do for me just pass them the money so i did so. Not long after, they said they would post me the road tax disc. After i didnt receive it, i took the advice from my fren that since no need to display road tax as tp if check can check thru system, i continued riding till May when i tried to renew my road tax for this year.

 

They told me that i had no road tax since november 06! apparently got some probs with my iu unit and therefore the road tax application rejected so had to go for a veh inspection( which i did in nov 06 when i paid them money to renew road tax). They said no prob settle for me everything just leave my bike there, already pissed but since they say they pay the fines and everything i left my bike there. Returned 4 days later to collect my bike, found out that my full tank petrol kenna siphoned off, so i went to complain and got some money for it.

 

If that was the last of my probs then good, but thats where it gets worst. I called LTA to check on my road tax as i was suspicious in the shop's dodgy dealings and found out that it HAD NOT been renewed. I called the shop and demanded a explanation and they had the cheek to say renew already confirm processed, which made me do a wild goose chase between lta and the shop finding out what happened. Until i made a complaint and got thru to a IO who called and told me to just leave the bike at the shop and demand a refund as

a) The transfer of ownership from previous owner has not been done

b) road tax expiry of more than 6 months.

c) some various other issues with the shop.

From what he said, my bike's road tax cannot be renewed.

 

So i need some advice. what's the next step that i can take.

Also if i just left my bike at the shop, how do i settle my financial obligation towards the 3 year installment plan with a finance company with 1 year almost finished.

So much complications, if i could just leave my bike with them and tear that contract and demanded some compensation, things would look much better than now.

perhaps u shd seek legal advice from a lawyer or might as well call the police.. and inform them that it was a scam case.. screw up the shop for good.

 

this kind of shop owners should juz choke to death when eating with the money they earn from u..

was thinking of going to case, but will go see the shop on monday hopefully setting a strong message across. but if it fails then gotta do something else

did they give you the receipt when you pay them to renew road tax for you? if no, it's your words against them. anyway, see what they say on monday. good luck bro....

i think if this is a scam den can report police liao saying tat they had cheated you.. den call up the media and report to case.. made this thing as big as possible.. btw which bike shop ar.. so that we all can will not get cheated by this bike shop...

If you have sufficient evidence, like reciepts for every single thing you have paid for then you have a strong case. This is very serious for them... I don't know alot regarding law, but it seems to me like a breach of contract.

 

Best is to talk to a lawyer and see what is the next best course of action. Case can't help you much if the shop doesn't even bother replying them. They have no legal power.

just had a talk with them, it seems the bike and its previous owner has too many offences not settled therefore the road tax cannot be renewed. the bike shop has offered to settle by buying back the bike by terminating whats owed to the finance company, bout 2 years of installments more.

I asked for at least my deposit back and they said they'll talk to their boss.

do u think i got a fair deal in the end. i've been riding for a year on it and have done some fair bit on it like top end overhaul, clutch plates, and other superficial stuff.

I'm not too sure if getting back the money you've spent on the bike is possible legally. You'll need to have reciepts to prove it even if its possible.

 

But the mininum you should get back is whatever money you've put in to pay for the bike. Meaning every single cent you've paid to them to purchase the bike should be returned to you. That however does not include the other self-incurred expenses such as petrol, parking, erp etc.

i dont see how i can tell them to pay me back my 1 year's worth of installments excluding all the various repairs i did elsewhere...

they can say that i've rode the bike for a year already and therefore used it.

how do u suggest that i go about doing this, i believe the minimum should be the downpayment or deposit amounting to bout 500. if i get this figure at least i would be more than happy.

Yah.... but you had tot for a year that you owned the bike....

 

Plus you could have gotten into a lot of trouble if you had an accident.... Plus think it could mean that you have not had insurance while riding for the past yr.

Basically, IF all that you have mentioned is correct and you have reciepts and letters to prove that you have paid for the bike but it was never transferred to your name then what they have done constitutes a breach of contract. In a case of breaching a contract there are 2 ways you can solve it.

 

1) Force them too fulfil their part of the contract. Meaning they tranfer the bike to your name by hook or by crook -> their problem.

 

2) Force them to return the money paid to you for the bike. Generally repair costs cannot be taken into consideration. You might have to double check with a lawyer on that. Meaning making things status quo or back to the point before you bought the bike.

 

I suggest consulting a lawyer and taking legal action. Then claim all the lawyers' fees from them. These a$$hole shops have to be taught a lesson.

Thats bad.

 

I definately think you should hire a lawyer to protect yourself. Because whatever it is, you have been driving that bike all the time that it didnt have a valid road tax and insurance. So what happen if TP come after you and charge you for this? IMO that is a bigger problem than just getting your money back!

1st bike - Kawasaki chopper.

2nd bike - 1 of the very few 125cc Dragstar... this bike went up Genting!

Current - 400cc Dragstar..

Next -.... 1100cc Dragstar......?

 

1st car - Starlet, 2nd car - Volksy Caddy, Current - Dat Terios

Next car will be another Volksy!

Potentially, they've placed you in a vunerable position to prosecution by the TP... You might be taking a risk if you do not take any action....

 

Why dun you try calling one of those law firms that advertises just to check things out?

u think the bike shhop even care for u ??? if u accident till no leg also they still ask u 2 pay the bike ..... so y do u even have to care about them ...... fight ... hire lawyer !!!!
