Yesterday was a raining day and the road condition was wet, I was heading toward bukit Panjang. I turn into this long bend located around Fajar Road and was traveling around 50km on that road when I saw a car infront reversing into the gate of a school (school closed) I slowed down a bit and as I was quite near her already, thinking she saw me at her side window (not side mirror) I increased my speed.

 

Suddenly, she just drive out and do a right turn, too late for breaking as I was just very closed to her car, I crash into her front side of the car. I think I slide for a few metres on my left side of the back and my head hit the right side of the road, lucky there was no oncoming car at that time.

 

After I sit up a bit, I remember sawing that the car was like in 45 degree position on the single lane two way road and my bike was lying at the edge near the centre line on the other lane. I was help out to the pavement and they went and moved my bike and her car was reversed back to the gate there.

 

I called my friends and was advised to get some witness, I tried to get and later found out that all so called witness there are her friends ( one of the lady was saying, the other driver was probably trying to follow her car. So, I asked her whether she can be my witness and she said, when she saw the accident on the mirror, I was already on the road.

 

One of her friends was saying usually in such case, we can try to settle privately and ask me to talk to the lady driver…

 

Later, I got her detail and was sent to NUH A&E by Civil Defence Ambulance

 

My friends who went there later saw that her car front bumper was ripped out and that my bike clutch bend in but was unable to take photos as it was dark and his mobile camera was not good.

 

I was discharged from NUH on the same night and would be making a police report today at Traffic Police HQ as I was told I need a slip of paper to collect my bike which is at old airport there.

 

Guys, please advise me on what to do as this is the first time, I got into such accident

 

Do I call her and ask her what she wants to do or inform my insurance company to handle it, I am very confused. Now on 3 days MC :cry:

 

But I must also say that I am happy as I am alive and just escaped with a those surface injury and I can still walk, talk and think.

 

One more thing, beside my mitsui insurance, I have also purchased a personal accident covering motoring accident as well from NTUC. can I claim from NTUC for the medical expenses first and then let mitsui handle the rest ?

basically she's turning out into the main road, she should watch out for you. hence in the rule, she's wrong. just inform your insurance claim from her case. but you shouldn't pick up speed either at that time, do it only after you pass the car. the car probably didn't see you is because...

 

1) visibility is low as it's raining

2) you're coming from a bend

3) motorcycle usually harder to spot (hence the switch-on light rule)

4) car is turning right, so she might be looking left, right, left then turn.

hi, good that you escape from the accident with just slight injury.

 

for your case, as there is personal injury, you need to make a police report and the police will investigate your case. usually vehicles from the small road have to look out and give way to the vehicles on the main road, so the lady is at fault.

 

you can also submit up a insurance claim against the lady driver and let the insurance company investigate. or if the lady driver is willing to setlle private to compensate you then you save the hassle to write to the insurance co for claims.

 

having said all that, do ride safely in the future as you were already aware of that car and if she does moveout without giving you way you should have horn and stop.

 

we are bikers, and there is no glory in claiming we have the rights after an accident if we were to lose a limp for it.

Yup, totally agree with you but when she decide to drive out, I was just maybe one metre or less from her car, how to stopped ? no way, anybody can do that.

 

I have called the lady and she said to claim thru insurance and she does not want to settle privately.

 

Anyway, when to see the Investigator Officer today, he say it is quite clear cut as I am on the major road and she is on the minor road, he is going to recommend point deduction and fine to his supervisor......does that mean that I am not the guilty party and in such insurance claim case, I am in the stronger position.

 

By the way, the school have a security tape of that car doing a reverse to the gate (eventhought not clear) and I have told the officer about it but he said it is not required as she is at fault. Should I still write to the school and ask for a soft copy ?

I see no harm trying to obtain a copy.... just in case of complications further down the road, etc etc.

Even the smallest spark can start a massive forest fire...

Next time , if accident , they wan to move your veh or their veh SAY TO THEM NO !!!! before u move at least take pics , you are lucky dat she didnt reverse tactic on u , and paint a different story , anyway speedy recovery .

Sorry to hear your accident. Hope a speedy recovery.

 

Not to add salt to wounds since accidnet already ahppened, but I would suggest you tap a horn to warn her if you notice that she didn't turn her head to your direction. This morning I rode at the right side of a BMW which has a lady driver in it, she just changed lane to the right, luckily I already standby my left thiumb at the horn and as she change lane, I horn her, she was so shocked that she applied e-brake! She must be in shock!

 

As for your case, I'm sure you can 100% win (u can claim 100% of your losses), since the Police is going to fine her and give her de-merit points, and since the Police is involved, you shd claim through insurance, anyway, I don't think she would like to settle it privately as the amount is quite substantial form your description of the accident.

Just curious, would I be given a report via mail from the Traffic Police on what action that they will be taking and usually how long ?

It takes a while, about 1 to 2 months, so give the TP a call if u don't receive it after 2 mths.

 

With this, u can submit a copy to the insurance to strengthen your case.

Just curious, anyone knows about mitsui insurance. I have a 3rd party, fire & theft policy from them and would like to know for third party claim, what is the limit the other party can claim on my insurance if there was an accident which was caused by me.

 

I heard from my friend that it is not more than $3 - $5K but I read my policy and it states that under liability claim, it is up to $500,000 for property and unlimited for person. At the same time, there was a $5K limit….one indemnity or something.

 

So does it mean suay suay I hit a merc and the cost is $10K, I have to pay out $55 K out of my own pocket ($10K - $5K). if this is so, buy insurance for what, if the cover is only $5K ?

as far as i know the amount they claim is approved by your insurance = mitsui on the payment.

 

but you dont have to fork out a cent base on what i experience the other time round. but with a certain amount of claim you will lose NCD follow up increase of your next insurance premium depending on how much the succesful claim from the other party..

 

correct me if i am wrong.

hi guys

 

Think I never updated this thread for awhile.

 

So just to close this thread.

 

My phantom repair cost is $2,500 and added on my other claim, came up to around $3,200. after haggling, it was settled at $2,800 or something. totally claimed from her insurance.

 

TP IO say that it is the woman fault and would recommend that she be deducted don't know how many point and until now I never even see the letter from TP.

 

Half a month later, I received a letter from my insurance saying that the lady driver insurance is claiming 10% of her repair cost, I told her that the IO say it is the lady fault and somemore I managed to make full claim from her side so why is she claimng from me and in such cases, is it admiting that I am partly a fault. The lady say no just that this is part of co-sharing of repair cost just that I am liable for only 10% and I would not be penalised for it. In anycase, I have already switch over to another insurance and have sold this bike.

 

Still I am wondering would I be penalised on my NCD

Hmmm, I don't know. Cost I just gotten myself a new bike recently and there was no increase in my insurance premium, now is just wait and see whether got NCD

I disagree and disputed with them but the mitsui say it is okie, they will pay. This is under the co-sharing rule or something
