Hey guys,

 

Just had an accident while I was coming back from home from lunch.

At a traffic light I was going straight and it was turning from green to amber, so I decided to cross the light, then suddenly from the opposite side I see a car taking a right turn. I was too fast and although I braked, I hit his rear left side and his car got some bad scratches. My bike is fine and I managed control the bike and stay upright without falling.

 

Both the driver and me exchanged contact details and IC numbers, but I forgot to take his license plate number.

Both of us dont have any witnesses.

 

Please advice what to do next?

Thanks bro. I will inform insurance company and also go to IDAC tomorrow morning.

I asked him how to settle and he said he will call his insurance and check with them.

My question is what is the worst case scenario for me? Will my insurance company have to pay for his damages or will my insurance company refuse to pay and then I have to pay?

If he says like that, am sure he is gonna file a report and claim againts your insurance. Maybe those more experienced can share whats the next step.. For me always have my lawyer to settle for me..

The only worst case senario is, the other party claimed from your insurance and you lose your NCD. Your insurance company will know the other number plate once they receieved the claim from them.

 

Actually your case still can fight. Cause from what I see, you have a higher upperhand here.

 

First of all the case can be your fault or the other party depending on how you interpret it. Cause "BY RIGHT" you should have slowed down before reaching a traffic junction. And he should have waited until the road is cleared and this is the crucial point. If by what you mentioned, it sounds like he had already decided to turn during the green->amber light despited seeing you approaching. If he had waited till the green arrow lighted up, you wouldn't have come in contact with him. Don't forget the green arrow takes a while to light up.

 

And there is no witness to prove who is in the wrong. Remember if there is no witness, rules from the basic theory comes in place. The one turning will have to give way to the one going straight. You can say in your report that it is still green light in your favour and the other party didn't give way. I will suspect the other party will say you beat the red light to have the case in his favour.

 

So it up to you. Normally for me, if it is clear cut my fault, I will just own up. For your case, I think both have to bear the responsibility but I would say he has to shoulder more blame than you.

But the shocking thing is the place of impact, I hit him at the rear right side(near the petrol cap), I am just wondering, if I couldn't slow down and if I was faster, he would have hit me head on. I wouldn't have been typing all this if that had happened.

 

This incident will make me really more careful on the road.

Don't worry about him claiming. Based on recent case, as long as the traffic light is in your favour, Vehicle making right turn sure lose the case. If he claims, he will want you to make a report as well so that the case can proceed asap. Otherwise wait for your insurance company to call you if it happens. In your report, make it really simple saying that you are going straight as the traffic light is green and the car sudden cut into your path.

As there is no damage to my vehicle, I dont really want to take this forward, but then since he could go and claim against my insurance, so to be on the safe side I am just going to report to IDAC, but not claim anything from him, as no damage done to me, so nothing to claim. Just want to safe from my side.

Yes bro, you should go to Idac and report your side of the story.

Else, the other party can just say u ran the red light and caused the accident.

 

If you are really across the lights at amber, the car should have checked for incoming traffic before turning right. Doubt the other party will say it's his fault, else he wont report at all.

If no witness, its his words against yours.

Hey guys,

 

Just got a letter from my insurance company that the car driver has made a claim of $2887. They have also asked me to reply with any comments,if I have. If not they will just proceed with it as they deem fit.

 

I think $2887 is way too much for those scratches isn't it? I have already reported to IDAC my story, isnt that enough? But I havent submitted the photo that I had taken, may be I will reply to the insurance guys once again with the photo.

from what is see the price is justifyable

 

i see not only scratch but dents

 

need to do paintjob

 

usually they will also ask for a replacement car for that time the car is in shop. that too they will claim.

1)At this point has it been decided that I am guilty and my insurance company has to pay? If not, who makes the decision? Is it my insurance company or some other neutral mediator?

2)In case the insurance company decides to go ahead and pay the whole amount, will they themselves bear the whole thing? Is there a limit for 3 party claims? I feel so sorry for them, my insurance premium per year is just 163$ with 10% NCD.

In this case NTUC is getting undue gains while MSIG is losing out, but I guess it will all even out when we consider all aggregate riders in Singapore. Hmm... they seem to have a built a fool proof system :(

I'm not sure whether they load the same amount. They should have a way to calculate. You just have to worry on the premium they gonna charge you. Anyway have you declare to your insurance you have the right of way? If do, then you just sit back and wait. But count yourselves lucky the driver only claim $2k+, to me it is quite okay for that damage. So if you lose the case, it will not be a big impact.

 

Try knocking into taxi, you will find all sort of funny claim.

BTW, called up MSIG and got the lady officer handling my case, same person who's name is on the letter i received.:)

 

She said the driver had a video camera and he has mentioned it was green in his favor, she not sure green light or green arrow, but if green arrow they will have to pay. Now she has asked for the video.

 

I am pretty sure it was amber when I was crossing so it can't be green arrow for him. So hopefully the video helps in getting the case to my favor
