i have rented a car some time back from a car rental company ....

 

i was a p plater .... i too have told them i juz passed my class 3 .....

 

rented out a nice looking honda stream ....

 

they ask me to check the car for scratch or dents so that they could record down on a paper wat was damage b4 i rent it out ....

 

that was it, sign one piece of paper containing the damages that was on the car already n declaration i was going to kl and the deposit i paid out .....

 

they too ask me to buy an insurance and i did .... they say in case of break down ....

 

happy bring the car back home .... then next day my trip to kl ....

 

everything went smooth to kl ..... sunway lagoon

 

went there too late .... sunway lagoon close already so decided to head back to melaka as i have a relative there .... sun coming down already ....

 

out of the blue the car dash board came out a engine type of icon .... i did not know wat it is but in a spit sec the engine died on the .... had to stop at a dangerious location at the road side .... anytime a lorry can juz hit my car .... decided to take out the triagle plate but to my surprice the car lock my rear door .... damn wat a day ..... after a few mins of cranking the engine the car start up .... drive up a bit the car stall again ....

 

i called up the company .... they sound pissed off .... then they say to pour water ..... lucky i have bring a big bottle along .... i pour the water in as he told me on the phone then the car can start ...... he told me to keep on doing this n i did ..... i stop by a petrol station to pour in some coolants ....

 

stupit me i did not ask for a recipt ....

 

headed back to melaka .... lucky no prob ....

 

the next day i did not drive the car as scared it gave problem ....

 

the following day time to go home ...... pack along 3 bottles of 1.5L....

 

right after the exit for melaka to singapore .... in a split sec i felt my aircon was rushing up .... my eyes look n the dash board at the temp guage ... it was rising fast n b4 i know it the engine stall ....

 

waiting fot the engine to cool down then pour in the water still can't start .... wat i notice is i keed on pouring the water it seems like the radiator dring my water .... it nvr seems to be full ... so i suspect there was something wrong .... look under but to my amazement no pool of water means no leaks lar ....

 

the malaysia emas came .... open the radiator cap ... n ask me to crank my engine ... i did as i was told n i was while i was cranking the water shoot out of the radiator .... the "emas" guy told me engine head gone case already .... i told the thanks n i called the car company ....

 

again he sound piss .... he as me to try cranking the engine .... i did till no batt aleady ..... he then told me to wait for the tow truck .... waited like 4-5 hours .... n the trip back home lasted 9 hours ..... (i have to cut short on my story)

 

then the next day went to the car company now the say .... i wack the car .... nvr stop ..... they say they change a whole engine to a 2nd hand ones ....

 

the told me to pay 80% for the damages ..... he told me the insurance i paid for is only for towing .....

 

i did not pay them .....

 

y ???

 

becoz for wat i know .... i m not responsible to service the car that i'm renting .... that's their problem ....

 

n i did not crash the car ..... it juz breaks down on me juz like that ....

 

they say if i crash an insurance can cover but the insurance does not cover breakdowns .... machanical failure .....

 

wat the hell ......

 

i already went to case ....

 

juz need ur views and any surgestions .....

Maybe u can name out the car rental company to prevent P-platers like us to go rent from them?

Firstly, they are only able to claim from you any excess from damages resulting from accidents.

 

Secondly, the rental contract did not state that you are unable to drive beyond certain R.P.M. Also, even if the contract states that you will be liable for any engine damages during return of the vehicle, the clause shall be void as it will not be seen as "REASONABLE" in the context of law.

 

Thirdly, driving an Auto car will not result in over-rev which will blow the piston.

 

Lastly, ask for a refund for renting you a faulty vehicle. If not, you may like to take it up to CASE.

Even over rev also have fuel cut .....and it does not overheat your engine, for your case is simply, They rent you a faulty car wilth radiator leaking and spoil your holiday causing great inconvience to you . You could in fact sue them if you have the time to play with them and request for independent partly to access to the damages of the vehicle that they accuse you of damaging.

actually ... i went to CASE aleady .....

 

i want no money returns .... juz to end this sad story .....

 

they got a cheek to send me "demand" letter .... which also wrongfully written ....

 

i can't type out the company here but if u wish to know u guys can pm me ....

i went down to fotocopy my agreement form ... they say this form can't leave this office ....

 

went CASE , case wrote me a letter to demand the agreement form ... they reply they have already given me the letter .... n also all the stupit detail about they had to go the troble picking me up at jb ..... this means they are not sincere ....

 

oh and also

 

i did went there to settal but they come out also a story bout other vehical (about a least 3 if i'm not mistaken) break down n the renter paid up ....

 

damn i won;t pay ....

 

 

once i rode my my honda ver s .... the radiator hose blew up on me .... but it still can reach melaka .....

 

a good maintain veh does not need to stop every now and then ..... it should not overheat too ....

 

i'm no expert n i have been skipping shool back then in my ite and also sleeping ...

 

but hell ... i'm glad i took the automotive technology (light veh) in ite balestier ....

 

like it or not some word from the trainer did come in my brain ....

Forget about going to CASE if you don't intend to take up the matter.

 

I'd advise you to ignore what they've wrote to you, even the letter of demand. In the event if they really sue (which I doubt they will due to the fact that the legal costs will outweigh the repair costs), there is a group of community lawyers that provide services Free-Of-Charge to those in need (terms and conditions apply).

 

For now, there's nothing to worry as they have no case against you.

Doesn't sound like they have any logical case at all. Get whatever documents legal documents you can from them(*smile 1st*) then after you get your hands on them tell them go F spider.

this has been draging for a long time ...

 

as i'm buzy at that time , i decided to ignore both case and the car company

after a long time of draging i receive a call yesterday at 4.15pm ... i juz started my shift work .... they call me and said "hello boy ! boy ! this is uncle here. you broke my car last year . still remember me ? "

 

once i heard "boy" my mind switch off like that so i told him i'm buzy which i was and put down the phone.

 

next they sms me like this ...

look, you HAVE the right to demand for a copy of any agreement you signed on as a customer. If they cant even give you a copy, it shows a lot about their integrity.

 

arrange with them to go down to discuss.

both parties can bear the cost equally or if both parties refuse to mitigate then just have to take it to court.

Since you are going to seek community legal advice, then just wait and see what they can come up with.

 

Expect their Debt Collection Dept to call on you and follow by home visit, and don't expect them to be nice.

 

You can arm yourself with a nice video camera to collect some real evidence of their intimidation and harassment which is their modus operandi.

 

Standby the number of the nearest NPP or NPC, in case things get out of hand or you feel that your family's safety is compromised.

Just my two cent worth....you should really take up the case and blow it big....once you see the community legal service...tell how bad your holiday was spolit by that stupid car and demand some...no more compensation from that rental company!tell them that when the car broke down your safety also at stake.

cannnot image if a big truck hit the car along the road (Sorry brother not curse you ) or you were robbed along the road....etc....

 

And tell the rental company to wake up man!!!! drive to KL then to Melaka "head" can gone.....you not driving a 1950 / 1960 scapyard cars lah....no logic...even u whack till "head" gone.....you will not be able to reach KL loh...
